Tyrrell County Court of Pleas & Quarter Sessions


October Session 1818

Ordered that John Houghton Daniel Bateman James Dillen & Richard Wood lay off to Elizabeth Powers widdow of Noah Powers deceased one years provision out of the estate of said deceased agreable to act of assembly & make return to the next term.

Administration on the estate of Sally Howett deceased was committed to Richard Howett and on the estate of Noah Powers deceased to Delilah Powers both of whom entered into bond with approved securities and qualified agreeable to law ordered that letters of administration issue thereon and that they proceed to sell the perishable estates of said deceaseds & account for the same as the law directs.

January Session 1819

An inventory & account of sales of the estate of Noah Powers was returned to court proved & filed.

Richd. Wood returned in court the years provision of Elizabeth Powers widow of Noah Powers deceased & filed.

October Session 1820

Ordered that Jno. Haughton Daniel Bateman & Rob. Wynne be appointed to settle and audite the accounts of Noah Powers deceased.

April Session 1821

Ordered that James Wood be appointed guardian ad litem to the heirs of Noah Powers deceased & that he ? ? ? the said heirs returnable to the next term naming each heir thereon.

July Session 1821

Ordered that John Houghton Robert Wynne and Daniel Bateman be appointed to audite & settle the estate of Noah Powers, also that the same persons audite & settle the estate of Joshua Powers deceased & make report to the next term.

October Session 1821

Report of auditors on the estate of Noah Powers deceased was returned in open court & filed.

Bond dated 12 Oct 1818 in the amount of two hundred pounds appointing Delilah Powers administratrix of the estate of Noah Powers deceased, Joseph Snell & James Dillin securities.

Laying off of a years provision to Elizbeth Powers widow of Noah Powers deceased on 4 Jan 1819. The estate having been sold, the widow was allowed forty dollars to be paid by the administratrix..

Summons dated 2 April 1821 and issued 18 Apr 1821. Execution was issued against the lands of Noah Powers in consequence of a suit by Alexander Dillin wherein he recovered one dollar and twenty five cents from the estate of Noah Powers. The heirs at law of Noah Powers are summoned to show cause, if any, why all or some part of the lands of Noah Powers should not be sold to satisfy this debt. Heirs named are Delilah Powers, Betsey Cohoon, Robert Bertee, Lois Bertee, Joseph Harris & wife and Rhoada Pendleton.

Audit & settlement of the accounts of Delilah Powers with the estate of Noah Powers deceased on 26 September 1821. Balance due the administratrix of $41.36 1/4 cents.

Undated list of the apparent heirs of Noah Powers listing Betsy Cohoon, Polly Jennett (minor), Priscilla Jennett (minor), Julian Jennett (minor), Robert Bartee, Lois Bartee, Jos. Harris & wife, Rody Pendleton, Rebecca Powers (minor), Charlotte Powers (minor) and Barbary Powers (minor).


Transcriber's Notes:
Noah Powers is cited as the son of Joshua Powers in his 1818 will. Deborah Powers was also cited as the wife of Joshua Powers. The other legatees of Joshua Powers are also heirs of Noah Powers. It appears that Noah had no children, his widow got her thirds, and his mother and siblings became heirs to the rest of his estate.

Phelps security; also Betsey Powers to Ebenezer Cahoon on 4 Jan 1813, Barney Jones security; also Charlotte Powers to Isaac Cullifer on 12 Jan 1828, Robert Bartee security; also Lucinda Powers to Robert Bertee on 13 Jul 1820, Samuel Spruill security; also Lydia Powers to Joseph Harris on 28 Mar 1792, Edmund Harris security; also Rhoda Powers to Zacariah Pendlton on 7 Mar 1819, Isaac Jennett security.
