In the name of God Amen: October 16th 1807. I Godfrey Phelps being in my perfect mind and memory do make and ordain this my last will and testament and my estate I bequeath and dispose of in the following manner.

First - I give and bequeath to my beloved son Asa Phelps my house and plantation with the land belonging to it to him and his heirs forever--- I also give him my crop of corn also I give him two beds and furniture and one cow and calf one ox one colt one hand mill and one gun and all my working tools of every kind ---

I also give and bequeath to my daughter Anne Phelps two beds and furniture to be equally divided between my son Asa Phelps and my daughter Anne Phelps I also give to Anne Phelps one chest, I also give to my son Asa Phelps my cart I also give the remainder part of my estate to be equally divided between my other children as follows that is to say my son Joseph & John Phelps or his heirs my daughter Mary Bateman my daughter Sara Bateman my daughter Elizabeth Lyons my son Jesse Phelps my son Derius Phelps my daughter Piscilla Swain.

I likewise constitiute and appoint my son Asa Phelps executor and my daughter Anne Phelps executrix to this my last will and testament and hereby do utterly disallow all and every other former testament will and legacy and executors by me in any wise before named willed or bequeathed ratifying & confirming this my last will and Testament in witness whereof I have hereunto set my hand and seal the day and date above mentioned.

October Session 1807

The last will and testament of Godfrey Phelps deceased was proved in court by the oath of John Phelps and Charley Phelps filed.

Asa Phelps came into court and quallified as executor to the last will and testament of Godfrey Phelps deceased.

Ordered that Asa Phelps have leave to sell the perishable estate of Godfrey Phelps deceased.
Also ordered that John Phelps Senr. Samuel Spruill and John Bateman Major divide the estate and make return next court.

January Session 1808

Asa Phelps returned in court on oath the account of sales of part of the estate of Godfrey Phelps deceased amount {blank} he also returned on oath the inventory of the estate of Godfrey Phelps filed.

Execution dated 29 Jun 1810 and issued 28 Jul 1810 against Asa Phelps executor of Godfry Phelps for 2 pounds, 19 shillings & 3 pence, which Uriah Chesson recovered for costs in a suit between the two.
