In ye name of God Amen. Know ye that I Godfrey Phelps being very weak in body but of perfect memory and understanding blessed be God for itt and calling to mind ye mortality of my body and knowing that it is apoynted for all men once to dye

Imprimis - First I recommend my Soul to God that gave itt me as my faithfull Creator hopeing att ye General Ressurection through ye merits of my blessed and mercifull redeemer Jesus Christ I shall receive a full pardon of my sins and I freely forgive all persons from my heart that have been injurious to me and as to my worldly Estate that itt has pleased God to endow me with I give and bequeath in ye manner and form following

I desiring nothing but a decent Christian burial att ye discretion of my Executors

Imprimis - First I give and bequeath to Elizabeth Phelps my beloved wife one bed and furniture and all my household goods excepting all my tools and I give her all my hogs sheep and bees and my riding horse and all ye cattle excepting them that are marked for my children those are left her to raise and suport all my children

Item - I give Cudberd Phelps my son one hundred acres of land beginning on ye pocceson on ye westward end of ye ___ Iland _____ along a line of marked trees between ye two plantations so to west Iland and I give him one cow and yearling and their increase of male and female.

Item - I give to my son Godfrey Phelps seventy five acres of land upon ye Second Creek commonly known by ye first ___ of ye ___ Prake land and I give him one _____ and one cow and yearling heifer with their increase of male and female

Item - I give to my son John Phelps one hundred of land with my manner plantation joyning upon Cudberd and I give hime my hand mill and a young cow and yearling with their increase of male and female

Item - I give to my two daughters Sarah and Elizabeth Phelps each of them one bed and furniture and each of them a chest and one young cow to Sarah and I give my mare to my three sons and her increase to be equally divided and further I do constitute and apoynt my wife Elisabeth Phelps and Joshua Phelps my Sole Executors of this my Last will and Testament and disanulling and revoking all will or wills by me made butt doe acknowledge this to be my last will and testament as witness werreof I have sett my hand and seal this twenty seventh day of February in ye year of our Lord 1750.

Present his Majestys Justices

These may Certifie that Joseph Spruill Junr and Joshua Phelps two of the subscribing evidences to the within personally apppeared in open court and made oath on the Holy Evangist of almighty God that they were present and saw Godfry Phelps sign seal publish and declare the within to be and contain his Last Will and Testament and that he the said Godfry Spruill (Phelps?) was then and at at that time of sound and dispossing memory; Then also appeared Elizabeth Phelps Executrix and Joshua Phelps Executor to the said will and were duly qualified by taking the executors oath in due form of law, ordred that the Honorable Nathaniel Rice Esqr. Secretary of said Province have notice that Letters Testamentory issue thereon as the law directs

September Session 1759

Personally appeared John Phillps guardian of Elizabeth Phillps and acknowledge his bond for the due performance thereof and on motion ordered to be filed and recorded.

Personally appeared John Phelps guardain to Godfree Phelps, John Phelps and Sarah Phelps orphans of Godfree Phelps deceased and acknowledged his guardain bond to our sd. court and on motion ordered to be recorded and filed.

On motion of John Phelp praying to sell three head of cattele & hoggs, part of the estate of Godfree Phillps orphan granted, and orders to returne accts. of sale to next court.

September Session 1760

Personally appeared Jeremiah Wynne and exhibited an acct. of sails of part of the estate of Godfree Phelps deceased & proved the same on his oath ordered to be recorded and filed.

March Session 1761

John Phelps exhibited an account of the estate of Godfree Phelps, Sarah Phelps and Elizabeth Phelps orphans of Godfree Phelps deceased and proved the same upon oath & ordered to be recorded.

June Session 1759 ?

On motion of John Phellps in behalf of Elizabeth Phellps to be appointed guardain to the sd. Elizabeth Phillps orpan of Godfrey Phillips deceased; granted and enters Jeremiah Wynne and John Parish securities in the sum of one hundred pounds procla. money.

Personally appeared Godferey Phelps, John Phillps, and Sarah Phellps, orphan of Godferey Phillps and by their own free will chose John Phellps their guardain who enters Jeremiah Wynne and John Parish securities in the sum of two hundred pounds proclamation money.
