In the name of God amen: This seventh day of December 1771 I John Marriner of the County of Tyrel and in the Province of North Carolina Cinder being verey sick and weak in body but of perfect mind and memory thanks be given unto God therefore calling unto mind the mortallity of my body and knowing that it is appointed for all men once to dye do make and ordain this my last Will and Testament that is to say principally and first of all I give and recommend my soul into the hands of God that gave it and my body I recomment to the Earth to be buried in a decent Christain burial at the discression of my Executors nothing doubting but at the General Resurection I shall receive the same again by the mighty power of God and as touching such worldley Estate wherewith it hath pleased God to bless me in this life I give demise and dispose of the same in manner and form followin.

Imprimis - I give and bequeath to my son Peter Marriner the land and Plantation which I purchased of Joshua Phelps containing by estamation fifty acres moore or less allso I give to my son Peter another parcel of land ginding the afsd. Plantation containing by estamation fifty acres moore of less to him and his heirs forever.

Item - I give and bequeath to my daughter Elizabeth Marriner two young cowes and calves and their incrase when she comes to the age of two years with one feather bead and furniture to her and her heirs forever.

Item - I give and bequeath to the child my wife now goes with if it is a son I give 10 pounds money to be put to intrust with good security when he shall come to age of five years allso two cows and calves and the increase after he arrives to the age of two years old to him and his heirs forever and if the said child should prove to be a daughter I give and bequeath two cows and calves & their increase when she arrives to the age of two years also one feather bead and furniture to her and her heirs forever and if the said son should dye I give one cow and calfe that was to him mentioned to my daughter Elizabeth and if my son Peter Marriner should dye without heirs I give and bequeath the land and plantation before mentioned to his youngest brother to him and his heirs forever - and if the child my wife now goes with should be a daughter and my son Peter Marriner should dye with heirs I give the aforesaid plantation and parcel of land to be equally divided between my two daughters to them and their heirs forever.

Item - I lend to my well beloved wife Tabitha Marriner the youse of the manner Plantation with all the remainder part of my estate freely to be prosed. and injoyed during her natural.

Item - I give to my wife Tabitha Marriner my watch with all my wareing clothes and working to her owne disposal likewise I give my wife all my book accounts with all my bonds and nots of hand.

Item - I give to my son John Marriner the Manner Plantation with the land thereunto belonging at his mothers death to him and his heirs forever.

Item - All the moveable estate before mentioned and land to my wife at her death I give to be equally divided between all my children to them and their heirs forever likewise I constatute make and ordain my well beloved wife and my sone Peter Marriner Executrix and executors of this my last will and Testament and I do hereby utterly disallow revoke and dsanull all and everey other former Testament Will Legacies and Bequeaths rattifying and confirming this and no other to be my last will & Testament in witness whereof I have hereunto set my hand seal the day and year above written.

February Session 1772

Hezekiah Spruill proved the last will and testament of John Marriner deceased & that he was of sound disposing mind and memory and Tabitha Marriner duly qualified as executrix of the last will and testament of sd. John Marriner

Tabitha Marriner returned a just and true inventory of the estate of John Marriner deceased and proved the same on her oath.

January Session 1783

Ordered that Peter Marriner orphan of John Marriner decessed be bound unto James Woods until he arrive to the age of twenty one years & the said Jas. Woods promises to learn the said orphan boy his trade. On motion of John Hamilton Esqr. ordered that Mrs. Tabitha Marriner be appointed guardian to her son John Marriner by choise of said son and give bond in 200 pounds John Hamilton & John Armistead Esqrs. securities.

July Session 1788

Thomas Stewart and Hezekiah Spruill Esquires appointed to audit and inspect and settle the accounts of guardians administrators and administratrix accounts of the deceased estates which is accordingly done as per entrys following to wit - Tabitha Marriner guardian of her son John appeared and declared she has no estate of his in her hands neither real or personal except 180 A land.
