In the name of God Amen I Samuel Mann being of sound and perfect mind and memory blessed be God do this day of October 2d in the year of our lord 1822 make and publish this my last will and testament in manner following that is to say first I give and bequeith to my beloved wife Sally Mann all of my lands that lie on Roanoke Island at her own disposal

I give and bequeith to my beloved wife Sally Mann my negro Rachel at her own disposal

I give and bequeith to my beloved wife Sally Mann my negro Polly at her own disposal

I give and bequeith to my beloved wife Sally Mann my negro Lilly (?) at her own disposal

I give and be queith to my beloved wife Sally Mann my ? ? ? at her own disposal

I give and bequeith to my beloved wife Sally Mann all my standing and moving property that is not above ? at her own disposal and my wife at liberty to give up any of the said property to pay my just and lawful debt

And I hereby make and ordain my worthy friend Zebulon Tarkenton executor of this my last will and testament in witness where of I the said Samuel Mann have to this my last will and testament set my hand an seal the day and yer above

Tyrrell County April Term 1827
I hereby certify that Carney Spencer and George Litchfield came into open court and after being duly sworn on the holy evangelist of almighty God deposeth and sayeth that they saw Saml Mann sign seal and execute the above as his last will and testament and that they signed as witnesses in the presence of the testator and that Nancy Spencer the other subscribing witness signed the said will in the presence of the testator as well as themselves - Given under my hand & seal of office this 23d day of April 1827

The last will & testament of Saml. Mann was exhibited in open court and proven on the oaths of Carney Spencer & George Litchfield and ordered to be recorded.

October Session 1830

Ordered that Jos. Halsey, David Clayton & Daniel N. Bateman or any two of them audite & settle the estate of Hezekiah Spruill & Saml. Mann & Sally Woodley & report to next term.

April Session 1831

Ordered that Jos. Halsey, D. N. Bateman & David Clayton be appointed auditors to settle the estates of Hezekiah Spruill & Samuel Mann & report to next term.

Ordered that Jos. Halsey, Daniel N. Bateman & David Clayton audite the estates of Hezekiah Spruill & Saml. Mann with Zebulon Tarkenton the administrator and report to next term.

July Session 1831

Ordered that Jos. Halsey, D. N. Bateman & David Clayton be auditors to settle the estates of Hezekiah Spruill & Samuel Mann and Sarah Woodley with the administrator Zebulon Tarkenton.

October Session 1831

Ordered that orders for settle the estate of Hez. Spruill, Samuel Mann & Sarah Woodly with the administrator Zebulon Tarkenton made at last term be renewed.

April Session 1832

Ordered that D. N. Bateman, David Clayton, Saml. Rogers & Jos. Halsey or any three of them audite and settle the estate of Hez. Spruill with the administrator Zeb. Tarkenton & also to settle the estate of Samuel Mann.

January Session 1833

Ordered that Jos. Halsey, Benj. Sikes, David Clayton & Daniel N. Bateman or a majority settle the accounts of Saml. Mann with the administrator Z. Tarkenton.

Mann, Samuel, 1827


Petition July term 1834 by Sally Mann stating that her husband Samuel Mann wrote his will in 1822 and, unrevoked, was duly exhibited and proved in 1827. The will devised to her his schooner, the Jovial Crew and other property amounting to one thousand dollars or some such large sum, all of which came into the hands of the executor Zebulon Tarkenton. She has frequently requested that he pay to her the monies due but he has delayed doing so under various pretenses. He died in 1833 leaving the estate unsettled and since his death Hardy N. Spruill has administered the estate of her deceased husband. She has also requested settlement of the estate by Hardy H. Spruill but he has also neglected to do so. She prays that subpoena issue to Hardy Spruill to appear at the next court, account for the estate and pay all monies due.

Deposition of Samuel Rogers on 9 Jan 1835 in the case Sally Mann vs. Zebulon Tarkenton's administrators. On 6 Oct 1827 he sold a negro woman belonging to the estate of Samuel Mann by an execution at the instance of Dempsey S. Godfrey. The said negro was bid off by Sally Mann and Zebulon Tarkenton paid the amount, which was $30.54.

Audit of the account of Zebulon Tarkenton executor of the estate of Samuel Mann deceased on 9 Jan 1835 by Jos. Halsey. The estate is due $227.14.
