In the name of God Amen. I Edward Mann of the County of Tyrrell in the state of North Carolina do make this writing my last will and testimony, revoking all others that amy appear Viz I first Resign my body to the ground from wherest it was to be buried in a Christian like manner my soulle to God who give it as touching my worldly estate that it has pleased God to bless me with Viz


Item I desire first that all my just debts be speedly paid by executor.


Item The plantation I purchased for Wm Midgett adjoining the lands whereon I now live I give and bequeath to my son Ephraim Mann to him and his heirs forever.


Item My plantation whereon I now live I give and bequeath to my sons Daniel Mann & William Mann to be divided between them agreeable to quantity and quality to them and their heirs forever.


Item My plantation on little alligator and deeded to me by John Murfy. I give and bequeath to my three sons Ephraim Daniel & William Mann to be equally divided among them agreeable to quantity and quality to them and their heirs and assigns forever and it is my will that if Either of my three named son should die before they become of lawful age, that the surviving sons or son shall have the portion that have been the lot of the deceased one.


Item I give and bequeath to my Daughter Mitildy Mann one hundred and fifty acres of land more or less on the eastward side Roanoke Island and adjoining the land that give to my son in law Daniel Meakins to her & her heirs and assigns forever.

Item All of the Lands that I hold on the South side of the (/) on Stumppie pint- I give and bequeath to my too sons Daniel and Wm Mann to them and theirs and assigns forever.

Item All other lands I hold on Bodies Island I give my three sons and too daughters sons Ephraim Daniel & Wm Mann Daughters Easter Meekins and Matilda Mann to them and their heirs and assigns forever.


Item I do give and bequeath unto my three sons and none daughter sons Ephraim Daniel & Wm Mann Daughter Matilda Mann to each of them one feather bed with the furniture that belongs (cut off) to be given to them by my Executors on the day of my Sale to them and their heirs forever.


Item I do give to my son William Mann one negro man by the name of Alen. Shoe maker by trade to him and his heirs forever.


Item All the rest of my negroes to be hired out until my son Daniel Mann becomes of lawful age then and Equal division to take place of all the negroes that is hired and too also that my daughter Easter Meekins has of mine one names of George and Silvy and if they Daniel Meekins and his wife should refuse to bring them at the day of the division then those that is hired will be equally divided between my three sons Ephraim Daniel & William Daughter Matilda Mann. But if they Daniel & Easter Meekins his wife Bring them for ward then an equal division among my five children above named.


Item I do give and bequeath to my friend (Cut off)is Midgett my too sail boats with her rigging and sails belonging thereto him and his heirs forever.

Item I desire that my stock on stumpy pint be kept for the Benefit of my children consisting of Cattle.


Item All of my stock on Bodies Island also at aligator consisting of horse cattle sheep and hogs Also all my plantation utentials at alligator together with my household snd kitchen furniture where I now live all the plantation utentials tools of all kinds together with my crop of corn & to my nets & canous I desire to be sold by my executor on a credit of twelve months. I desire that part of my property may be carried to alligator to be sold also my negroes carried to alligator to be hired all of my lands to be rented until my children become of lawful age to receive their portion.


Item I desire my friend Lewis Mann to take my son William Mann and his negro man Alen and Educate my son.


Item All the money arising from the sales of my property & hire to be for the Benefit of my five children above named-


Item I do here by institute and appoint my too friends Lewis Midgett and Samuel Spruill Esqs. as executors to this my last will and testament and I do hereby revoke all others. In witness of all and each of the things herein contained I have hereunto set my hand and seal this 18th day of September in the year of our Lord one thousand Eight hundred & 16

January Session 1817

The last will & testament of Edwd. Mann deceased was exhibited in open court & proved by the oath of Saml. Midyett & Thomas Mann subscribing witnesses thereto & filed.

Saml. Spruill & Lewis Midyett appeared in open court & quallified as executors to the last will & testament of Edward Mann in due form of law.

April Session 1817

Saml. Spruill & Lewis Midyett executors to the estate of Edwd. Mann deceased returned on oath the inventory & account of sales of said deceased & filed.

The audited account of Edward Mann deceased was returned to court by Robt. Pledger Esqr. & filed.

January Session 1818

Ordered that Saml. Spruill be allowed one hundred and one dollars for the expenses of Ephraim Mann orphan of Edwd. Mann deceased up to Jan 1 1818.

Ordered that Danl. Meekins be allowed thirty six dollars & forty nine cents for keeping Matilda Mann orphan of Edwd. Mann deceased up to Jan 1 1818.

April Session 1818

Ordered that Samuel Spruill executor of Edwd. Man deceased be allowed the sum of eighty dollars for board clothing & schooling Daniel Mann up to 10th August 1817 as per account filed.

January Session 1819

Ordered that Samuel Spruill trustee for Ephraim Mann orphan of Edward Mann deceased be allowed the sum of $255.84/100 for his board schooling & clothing for the year of 1818 agreeable to the account allowed & filed.

Ordered that Danl. Meekins be allowed the sum of $49.87 for boarding schooling & clothing Matilda Mann orphan of Edward Mann deceased for the year of 1818 agreeable to account filed.

January Session 1820

Ordered that Daniel Meekins be allowed the sum of $42.15 1/2 cents for board schooling & clothing Matilda Mann for the year 1819 as per account allowed by the court & filed.

Ordered that Samuel Spruill be allowed the sum of thirty one dollars and twenty four cents for clothing furnished Ephraim Mann as per account exhibited & allowed by the court & filed.

January Session 1822

Ephraim Mann was appointed guardian to Matilda & William Mann orphans of Edward Mann who entered into bond in the sum of sixteen thousand dollars with Thomas Leigh & Samuel Spruill his securities ordered that he receive the estate of the said orphans into his possession & account for the same as the law directs.

April Session 1822

The following guardians appeared in open court & renewed their guardian bonds agreeable to the act of assembly in that case made & provided as follows viz. - -
Ephraim Mann guardian to Matilda & William Mann

Report of the division of the negroes belonging to the estate of Edward Mann deceased was returned in open court & filed.

July Session 1822

Ephraim Manns legatee bond for his distributive share of the estate of Edwd. Mann deceased was returned in open court & filed.

Ephraim Manns legatee bond for the distributive shares of William & Matilda Mann of the estate of Edward Mann deceased was returned in open court & filed.

Daniel Meekins legatee bond for his distributive share of the estate of Edwd. Mann deceased was returned in open court & ordered filed.

October Session 1822

Account of sales of cattle beloning to the heirs Edward Man deceased amounting to $262.74 cents was exhibited in open court and proved by the oath of Ephraim Man and filed.

January Session 1823

A plat of the division of the lands of Edward Mann deceased was returned to court & ordered to be registered.

April Session 1823

Ephraim Mann guardian to William Mann returned on oath his guardian account stating ballance due upto 1 April 1823 $1523.08 cents & filed.

Ephraim Mann guardian to Martha Mann returned on oath his guardian account stating a ballance due upto 1 April 1823 $1271.70 & filed.

October Session 1823

A residuary inventory of cattle belonging to the estate of Ewd. Mann deceased on Stumpy Point was returned on oath & filed amt. $141.65.

April Session 1824

Ephraim Mann guardian of Wm. Mann returned in open court his guardian account for the year ending the 26 Apl 1824 with balance due the guardian of $10.69 1/2.

Ephraim Mann guardian of Matilda Mann returned in open court his guardian account for the year ending the 24th Apl 1824 with a balance due guardian of $121.80.

January Session 1825

Guardian account of Ephraim Mann v Wm. Mann for the present year was returned in open court. Balance due Wm. Mann $44.40.

April Session 1827

Ephraim Mann guardian of Wm. Mann returned into open court his guardian account for the year 1826 amounting to $125.85 amount of credits for hire of negroes amounting to $125.85 with a balance due Wm. Mann as per account filed of $36.95.

January Session 1829

Eph. Mann came into open court and renewed his guardian bond to William Mann.

April Session 1829

Eph. Mann guardian of Wm. Mann returned an account of ? ? for the year 1827 & 1828 balance due $6.20 for 1827 & 1828 $24.88.

Petition October Term 1819 by Daniel Meekins and his wife Esther formerly Esther Mann Matilda Mann William Mann & Ephraim Mann who say that Edward Mann devised in his will all his real and personal estate to your petitioners and to Daniel Mann who died shortly after making said will. Petitioners pray for division of all the real and personal property left by Edward Mann to Daniel Mann among your petitioners.

Answer October Term 1819 by Samuel Spruill & Lewis Midyett executors to the last will and testament of Edward Mann. Defendants admit that Daniel Mann was a devisee and legatee in the will of Edward Mann and is now deceased. Petitioners were also devisees and legatees. Defendants do not know if they should wait until the time that Daniel Mann would have legal age to make the divisions called for in the will or do it now. They pray for a court order.

Petition January Term 1821 by Damiel Meekins and wife Esther Ephraim Mann & Matilda & Wm. Mann infants by their guardian Ephraim Mann stating that Edward Mann the father of your petitioners Esther Ephraim William & Matilda duly made and published his last will and testament about 1816 and appointed Samuel Spruill & Lewis Midyett his executors. Samuel Spruill has since taken upon himself the principal burden and execution of the whole except $403.03 1/2 which remains in the hands of the said Lewis and is now due your petitioners. They also charge that there remains in the hands of Samuel Spruill after paying debts and commissions, etc. $5488.43 1/2 due your petitioners. Also the cattle on Stumpy Point which were to be divided when Daniel Mann reached the age of twenty one years, which would have been in the year 1823 had he lived. Petitioners say that the executors are now willing to come to account & division of the whole property willed to them by the said Edward Mann including the negroes to which they are or may be entitled. Petitioners pray that the executors answer this petition on oath and account fully with them. Petitioners further state that Daniel Mann son of Edward Mann and brother of your petitioners died intestate without issue and under age owing no debts in August 1818 and they are entitled to his share.

Undated answer of Samuel Spruill & Lewis Midyett to the petition of Daniel Meekins and wife Esther & Ephraim Mann & Matilda & William Mann infants by their guardian Ephraim Mann who state that all the facts in the petition are true. Defendants pray that they may be discharged after their candid disclosure with their reasonable costs.

Bail bond dated 24 Sep 1821 in the amount of three hundred and thirty seven dollars and seventy eight cents in which Josiah Simpson binds himself to personally appear at court on the first Monday after the fourth Monday in September 1821 and answer unto Samuel Spruill executor of Edward Mann deceased of a plea of debt in the sum of one hundred and nineteen dollars and eighty nine cents and one hundred dollars damages. Bail bond dated 24 Sep 1821 in the amount of three hundred and thirty seven dollars and seventy eight cents in which Ozias Roughton binds himself to personally appear at court on the first Monday after the fourth Monday in September 1821 and answer unto Samuel Spruill executor of Edward Mann deceased of a plea of debt in the sum of one hundred and nineteen dollars and eighty nine cents and one hundred dollars damages. Bond dated 31 Dec 1821 in the amount of sixteen thousand dollars appointing Ephraim Mann guardian of Matilda & Wm. Mann orphans of Edward Mann deceased, Thomas Leigh & Saml. Spruill securities.

Legatee bond dated 4 Jan 1822 in the amount of six thousand dollars. Samuel Spruill & Lewis Midyett executors of Edward Mann deceased have paid over to Ephraim Mann guardian to Matilda & William Mann two of the legatees under the will of said deceased their distributive share of the personal estate of the said deceased of the value of fourteen hundred and seventy two dollars & eighty six cents each. Should any further debts arise owing by the estate of Edward Mann the said Ephraim Mann guardian to Matilda & William Mann binds himself to pay the ratable part of the same. Thomas Leigh is security.

Account of sale on 29 Dec 1823 of Josiah Simpson's right in 31 1/2 acres of land to Samuel Leigh for Ephraim Mann for $20.52 1/2 at 65 cents an acre.

Subpoena issued 4 Sep 1824 for Samuel Midyett Senior & Joseph Rollins to appear at the next term of court and answer unto Ephraim Mann guardian of Matilda & William Mann and answer unto him one hundred and eighty one dollars and eighty one cents which they owe and from him unjustly detain to his damage fifty pounds. Flyleaf says Ephraim Mann guardian Jonathan Lindsey of Jno. real plaintiff vs. Samuel Midyett Senr. & Joseph Rollins.

Bail bond dated 6 Oct 1824 in the amount of four hundred and sixty three dollars and seventy eight cents in which Samuel Midyett Senr. & Thomas Midyett bind themselves to personally appear at court on the fourth Monday in October 1824 and answer unto Ephraim Mann guardian to Matilda & William Mann in the sum of one hundred and eighty one dollars and eighty nine cents and 50 pounds damages.

Ephraim Mann's guardian account for William Mann for the year 1825.

Bond date 27 Jan 1829 in the amount of five thousand dollars in which Ephraim Mann is appointed guardian of William Mann a minor orphan, Samuel Leigh & Edmund Alexander securities.

Schedule bond dated 1 Oct 1833 in the amount of seventy nine dollars and ninety cents in which Zebulon Tarkinton & Daniel Ansley bind themselves to appear in court on the 4th Monday in October to respond to a ca sa issued at the instance of Ephraim Mann guardian to Wm. Mann for the use of Tully Wynne for thirty nine dollars and ninety five cents.

This file contains numerous other documents relating to recovery of debts owed the estate of Edward Man deceased which have little if any genealogical significance.
