In the name of God amen: The sixth day of February in the year of our Lord one thousand seven hundred and ninety. I, Thomas Mann of the province of North Carolina being very low in health but of perfect mind and memory thanks be given to God for it But calling to mind the mortality of the man and knowing that it is once appointed for all men once to die I do therefore constitute make and ordain this my last Will and Testament in manner and form following. That is to say first of all I recommend my soul in the hands of God that gave it and my body to the earth to be buried in a Christian like manner at the discretion of my executors and as to such worldly estate wherewith it hath pleased Almighty God to bless me with in this life I give devise and dispose of the same in the following manner and form Viz:

First - My will is that all my just debts and funeral charges be paid and settled by my executors as soon as they conveniently can after my decease.

Item - I give and bequeath unto my well beloved wife Christian Mann one third part of my dwelling house wherein I now live and out houses also one lthird part of the track of land on Croatan whereon I now live to my said wife during her life or widdowhood.

Item - I give and bequeath unto my daughter Mary one shilling I give to my son John the other two thirds of my track of land whereon I now live and his heirs forever.

I give to my Thomas fifty of land laying on Durius Island also one hundred acres laying on the uppermost part of Croatan known by the name of the Mirtle thickett to him his heirs forever. My is also that all my personal estate be equally divided between my five children Patsey Dorothy Sara John & Thomas except ten pounds of my said personal estate to be given to my grandaughter Patsey Hassell at my decease, and lastly I do hereby contitute ordain and appoint my loving wife my son John and John Payne to be my only and sole executors & executrix of this my last Will and Testament and I do hereby disannul revoking disavowing every other former Testament will Signature requests execute by me any way before this time named willed and bequeathed ratifying and confirming this and no other to be my last Will and Testament in witness whereof I have hereunto set my hand and affixed my seal this the day and year above written.

The last will and testament of Thomas Mann was produced into open court and proved by the oath of Samuel Spruill Esqr. who swore that it was the handwriting of Saml. Mann who which was subscribed as a witness thereto, & that the said Samuel Mann was dead whereupon it was ordered for probate and John Mann qualified as executor thereof.
