In the name of God amen: I James Miller of the County of Tyrrell and the State of North Carolina Planter being weak of Body but of perfect and sound mind and memory thanks be to Almighty God and calling to mind the uncertainty of death and knowing that it is appointed for all men once to die, desire to make and ordain this my last Will and Testament in manner and form following.

First and principally I recommend my soul into the hands of God that gave it nothing doubting but at the General Resurrection at the last day to receive the same again being thro, the merits death and passion of my blessed Saviour Jesus Christ to have full and free pardon of all my sins and as for my body I recommend to the Earth to be decently buried at the discretion of my Executors hereafter named and as for such worldly Estate as it hath pleased God to bestow on me in this life, I give demise and dispose of in manner and form following.

Imprimis - My will and desire is that all my just debts and funeral expences be all satisfy'd and paid.

Item - I give unto my well beloved Father and Mother Thomas Hawkins and Elizabeth Hawkins the use occupation and enjoyment of the Plantation whereon I now live during their lives and also my stock or stocks of horses hogs cattle and sheep to them during their natural life -

Item - I give unto my well beloved Father and Mother Thomas Hawkins and Elizabeth Hawkins all my household and kitchen furniture to them during their life.

Item - I give unto my well beloved wife Anna Miller the Plantation whereon I now live and also all my household and kitchen furniture also my stock or stocks of horses, hogs, cattle and sheep to use and enjoy, after the decease of my father and mother Thomas Hawkins and Elizabeth Hawkins, during her widowhood or marriage and no longer.

Item - I give and bequeath unto my children my House and Plantation whereon I now live together with all my household goods and kitchen furniture, stock or stocks of horses hogs cattle and sheep together with all the residue and remainder of my whole Estate to be equally divided between them at the death or marriage of my wife Anna Miller -

Lastly - I nominate constitute and appoint my well beloved friend Enoch Leary Executor and my well beloved wife Anna Miller Executrix to this my last Will and Testament hereby revoking all other Will or Wills by me heretofore made allowing this to be my last Will and Testament - In Witness whereof I have hereunto set my hand and fixed my seal this 29th day of January 1790.

Personally appeared James Long son of Andrew and made oath on the Holy Evangelists of Almighty God that he saw and heard James Miller above named sign, seal, publish, pronounce and declare that the above and within instrument of writing to be his last will & testament and at that time he was of sound disposing mind & memory & at the same time he saw Cornelius Leary a subscribing witness sign his name thereto and further saith not.
