In the name of God amen: The seventh day of April in the year of our Lord one thousand seven hundred and sixty I John McCaskey of the Province of North Carolina and of Tyrrel County being very sick and weak of body but of perfict mind and memory thanks be given to God for the same and knowing that it is appointed once for all men to die do make and ordain this Instrument of writing as my last Will and Testament First I recommend my soul into the hand of Allmighty God who gave it and my body I recommend to the Earth to be buried in a decent like manner according to the duretion of my Executors herein after nomenated and appointed and as for such worly Estate wherewith it hath pleased God to bless me with in this life I give and dispose of in the manner and form following.

Imprimis - I will and desire that all my just debts be paid and staisfied.

Item - I give unto my son John McCaskey a certain tract of land and plantation being the place whereon I now do live containing four hundred acres be the same more or less beginning at a Spanish Oak thence runing up by a linne of marked trees over the Grate Branch up Beautys Branch the to William Downings corner pine thence to John Baptist Ash's corner thence along a line of marked trees the former line thence back of John Baptist Ash's lline to the first station I say to my son John McCaskey him his heirs and assigns forever.

Item - I give to my son Jehu McCaskey a certain tract of land and plantation containing four hundred acres be the same more or less beginning at the mouth of the Cut near the river thence up the Cut to a Poplar thence along Capt. William Downings line to the corner before mentioned thence down the said dividing line of marked trees between the said John McCaskey and Jehu McCaskey then down the Spring Branch to the river Pocoson thence the manders of said Pocoson to the first station I say to my son Jehu McCaskey to hime his heirs and assigns forever.

Item - I will and desire that the lands lying near the Main Road containing two hundred acres adjoining John Whitley's line on a swamp called the Mirtle Branch swamp thence up Connehoe Creek to a branch called the Briery Branch thence

Up the sd. Branch to a corner pine then up the road the north side to a beginning I will and desire that the said land be sold and the money arising be eaqually dividing between my three daughters Susanna, Mary and Pennelope McCaskey. I say unto my said three daughters as aforesaid.

Item - I give unto my son Jehu McCaskey on hundred acres of land of land be the same more or less lying up above the Great Cut upon the forked Cut I may unto my son Jehu McCaskey to him his heirs and assigns forever.

Item - I give to my daughter Chloe Pearce five shillings sterling raised and paied out of my Estate.

Item - I give unto my loving wife Mary McCaskey all and singular my goods and chattells not already given be it or they of what nature or kind soever I say unto my loving wife during natural life and afterwards whatsoever may then be then produced I give unto my son Jehu McCaskey.

Lastley - I nomenate and appoint my loving wife Mary McCaskey and my son John McCaskey Executor & Executrix of this my last Will and Testament Revoaking disannulling and making void all other Legacyes Wills Bequest by me heretofore made Ratifying and Confirming this and no other to be my Last Will and Testament.

In witness I have hereunto sett my hand and affixed my seal the day and year first above mentioned.

September Session 1760

Personally apeared John McCaskey and qualifyed executor of the last will and testament of John McCaskey by taking the oath of an executor ordered that the clark certify the same to the Secretary of the Province that letter issue accordingly.

Personally appeared John McCaskey and exhibited an inventory of the estate of John McCaskey deceased and proved the same upon his oath; ordered to be filed.
