April Session 1832

Ordered that Ephm. Mann be permitted to administer on the estate of James McCalister.

Ordered that E. Mann administrator of James McCalister proceed to sell the perishable estate of said deceased.

July Session 1832

Ephm. Mann administrator of James McCalister returned into open court on oath the account of sales of said estate.

January Session 1834

Ordered that H. G. Spruill, Abner Alexander & Jno. Midgett audite and settle the estate of James McCalister.

Ordered that Ephm. Mann be appointed guardian to Zaneth, Jno. & Phobe McCalister orphans of James McCallister, securities H. G. Spruill, Abner Alexander & Geo. H. Alexander.

April Session 1834

E. Mann administrator of James McCalister returned into court the audited account of said estate & filed.

Note from Maria McAllister dated 23 Feb 1832 assigning administration of her late huband James McAllister's estate to Ephraim Mann. Witnessed by Saml. C. Patrick.

Bond dated 28 Feb 1832 in the amount of five hundred dollars appointing Ephraim Mann special administrator of James McCalister deceased, Richard Howett & Henry E. Lewis securities.

Bond dated 23 Apr 1832 in the amount of ten thousand dollars appointing Ephraim Mann administrator of the estate of James McCalister deceased, William Spruill & Saml. Leigh securities.

Petition April Term 1832 by Mariah McAllister who states that her husband James McAllister died intestate, having made no provision for her immediate support. She therefore prays for the appointment of three freeholders to view the crop, stock etc. on hand and if enough to allot therefrom sufficient for her support for one year - otherwise to estimate the value of such years support, to be paid her by the administrator of said estate.

Bond dated 28 Jan 1834 in the amount of five thousand dollars appointing Ephraim Mann guardian to Asenith, John & Phoebe McCallister orphans of James McCallister deceased, Hezekiah G. Spruill, Abner Alexander & George H. Alexander securities.

Petition at October Term 1834 by Edward Owens and wife Maria and William Morris and wife Zanith who state that James McAllister departed this life in March 1832 and Ephraim Mann administered on his estate. The said James left the following persons as his distributees viz. Maria who has since intermarried with one of your petitioners Edward Owens, daughter Zanith who has since intermarried with your petitioner William Morris and children John & Phoebe who are at present under age, with Ephraim Mann as their guardian. Petitioners further show that said James died possessed of a considerable personal estate consisting of the following named negros, to wit, {Rest of page is blank.} Petitioners pray that commissioners be appointed to allot to them their respective portions of the negros so they may own them separately as sole tenants and not as tenants in common with the infant distributees. Petitioners further pray that process be served upon the said John & Phoebe by their guardian Ephraim Mann making them defendants to this petition. Petitioners are willing to defray the costs of this application. Commissioners appointed were Abner Alexander, John Midget, H. G. Spruill, Leml. Basnight & Joseph Pledger or a majority of them.

William Morris and wife Zanieth daughter of said deceased:
Negro man George age 46 value - $400
Negro woman Nelly age 40 value - $250
Negro boy Matthias age 8 value - $250
John McCallister a son of said deceased:
Negro man Isaac age 35 value - $425
Negro boy Primas age 6 value - $200
Negro girl Betsy age 10 value $275
Phoebe Ann McCallister a daughter of said deceased:
Negro boy Harmon age 12 value - $350
Negro girl Mary age 3 value - $150
Negro girl Olive age 23 value - $400

Petition at January Term 1835 by Edward Owens and wife Maria stating that James McAllister died in February 1833 leaving a widow who has since intermarried with Edward Owens and three children. It is further stated that the intestates widow Maria was totally unprovided for by the law - that her husband died possessed of a tract of land adjoining the lands of Ephraim Mann & James Swain - petitioners therefore pray that the Sheriff summons a jury to lay off to your petitioner Maria her dower in her intestate husband's estate.

Bond dated 26 Jan 1835 in the amount of twenty two hundred dollars appointing William Morris guardian to Jno. & Phoebe McCallister orphans, William Mann & Nelson Alexander securities.

Petition January Term 1835 by William Morris and wife Zanniet and John & Phoebe infant children of James McAllister by their guardian William Morris. Petitioners state that James McAllister departed this life intestate in February 1833 leaving a widow and three children viz. Zaniet, John & Phoebe - that Maria the widow has since intermarried with Edward Owens and Zanieth intermarried with petitioner William Morris - and at January Term 1835 of this court your petitioner was appointed guardian of John & Phoebe. Petitioners further show that James McAllister died possessed of a tract of land adjoining Ephraim Mann & James Swain containing from one hundred to one hundred and fifty acres. Petitioners pray that an order be issued to the Sheriff to summon five commissioners to allott off and divide the lands aforesaid and that process issue against Edward Owens and wife Maria making them defendants to this petition.

Bond dated 23 Apr 1838 in the amount of three thousand dollars appointing William Morris guardian to Jno. & Phoebe McCallister orphans of James McCallister deceased, Thomas Hassell & Samuel Simmons securities.


Transcriber's Notes:
Tyrrell County marriage bonds show the marriage of James McAllister to Sui Rowton on 5 Oct 1815, James Hassell security; also James Maccalister to Mariah Liverman on 13 Oct 1821, Richd. Howett security. Based on when James McCalister married Mariah Liverman, she would not have been the mother of Zanith, so James appears to have married twice.
