In the name of God Amen.

I Mary C. Mann of the State of North Carolina and County of Tyrrell do make and ordain this as my last will and testament in manner and form following (Viz).

Item 1st I give and bequeath to my brother and sister Samuel R. Batman and Fanie E. Brickhouse all of my tract of land in Martin Co. to be equally divided between them.

Item 2d I give and bequeath to my brother Samuel R. Batman all of my interest in the tract of land on which I now live known as Henry Batman heirs land my part, I the said Mary C. Mann.

Item 3d I give to my sister Amanda S. Mason my wardrobe and bed.

Item 4th I give to my niece Eliza L. Batman my bureau.

Item 5th I give to my brother Thomas S. Batman my cow and calf.

Item 6th I leave to my brother Nathan W. Batman five dollars to be paid by my executor hereinafter named out of the legacies left Samuel R. Batman.

Item 7th It is my last will and desire for my executor hereafter named to reserve money out of the legacies give to Samuel for the purpose of buying tombstones for six graves. He shall be the judge what they shall cost.

Item 8th With the confidence I have in my brother Samuel R. Batman I leave my afflicted brother Nathan W. Batman to be provided for by him as long as they both shall live.

All the ballance and residue of my personal property after my just debts are paid I give to my brother Samuel R. Batman. I nominate and appoint my brother Samuel R. Batman Executor to this my last will and testament.

In witness whereof I have this 18th day of November 1885 my hand and seal and declare this to by my last and only will and testament in the presence of.

In the Matter of
The Last Will and Testament of Mary C. Mann Affidavit

A paper writing purporting to be the last will and testament of Mary C. Mann with the names of Benj. F. Sikes and W. E. Hassell as subscribing attesting witnesses thereto and with Samuel R. Batman named therein as executor, and bearing date of November 18th 1885 is exhibited by Samuel R. Batman for probate, and concerning the execution thereof. Benj. F. Sikes and W. E. Hassell being duly sworn each deposes and says, that on the 18th day of November 1885, they each saw the said Mary C. Mann sign the said paper writing and declared the same to be her last will and testament in their presence. And in her presence and in the presence of each other they each subscribed their names thereto as they appear thereon as witnesses to the same. Also each for himself says he believes that the said Mary C. Mann at the time of the making and signing said will and testament, was of sound mind and memory and capable of making a will.
