In the name of God amen: I Thomas Leary of the County of Tyrrel in the Province of North Carolina being sick in body but of sound and disposing mind and memory praised be the Almighty and knowing that it is appointed for all men once to die, do make and ordain this my last Will and Testament in the manner following -

First - I give and recommend my soul into the hands of God my Maker and my body to be buried in a Christian like and decent manner at the discretion of my Executors, and as for such worldly goods as it hath pleased God to bestow upon me, I give and dispose of the same in the manner and form following Viz:

First - I give and bequeath unto my grandson Thomas Simons my negro fellow Nero to him and his heirs forever -

Item - I give to my daughter Penelope Penrice one bed.

Item - I give to my grandson Thomas Penrice my negro girl Chat to him and his heirs forever -

Item- I give the use of my negro boy Michail to my grandson Thomas Leary and at his death I give the said negro boy Michail to my son Joshua Leary and his heirs forever -

Item - I give and bequeath to Argill Simons one shilling sterling.

Item - I give and bequeath to my son Joshua Leary all the remainder of my Estate of negroes land horses, hogs cattle and sheep household goods and utensils and all other of my whole Estate of what nature or kind soever, to him the said Joshua Leary and his heirs forever and I do hereby nominate and appoint my said son Joshua Leary and my two friends James Long and John Swain Esqr. Executors to this my last Will and Testament and I do hereby utterly revoke and disannull all former and other Wills by me made hereby ratifying and allowing this to be my last Will and Testament In testamony whereof I have sign'd seald and publish'd this as my last Will and Testament this fifth day of February Anno Domini one thousand seven hundred and eighty.

The last will and testament of Thomas Leary was proven open court by the oath of Nichos. Gilbert - ordered to be recorded - ordere that letters issue.

Joshua Leary appeared in open court and quallified as exor to the last will and testament of Thos. Leary.
