Dated 13 December 1877


In the name of God Amen I Bartlett Jones Senior of the County of Tyrrell and state of North Carolina being of sound mind and memory but having in view the shortness of life and certainty of death do make and publish this my last will and testament in manner and form following to wit

Item 1st I resign my soul to the God who gave it with humble gratitude for his manifold blessings. And desire my body interned in a decent manner by my executors out of my personal estate.

Item 2nd I give devise and bequeath unto the Children of my son Bartlett Jones Jr. theirs heirs and assigns one of the tracts or parcels of land situated in Gum Neck whereon my son Bartlett Jones Jr. now resides adjoining Caroline Basnight heirs Ruben Cahoon and others and one other tract of land which formerly belong to Timothy Jones adjoining Reuben Cahoon and others and bounded as follows beginning at a light wood Post at the Patent line thence westwardly with the Patent line to the Corner of the Patent line to and opposite the land between Rueben Cahoon and the said tract of land thence Eastwardly to the first station and I also give devise and bequeath unto the children of my son Bartlett Jones Jr. and their heirs and assigns all the stock of cattle horses & house hold and kitchen furniture and farming implements and utensil which belongs to said farms and in the possession of the said Bartlett Jones Jr. which I have loaned to him. it is my will and desire and it is hereby declared that the foregoing bequeath both of real and personal estate in this Item (2) two of this will is made to all the children of my said son Bartlett Jones Jr. Including those now living and hereafter to be borned unto him the said Bartlett Jones Jr. except Fredrick Franklin Jones son of Bartlett Jones Junior who has already been provided for by gifts from his father Bartlett Jones Jr. In order to carry out the above request I hereby constitute my son Bartlett Jones Jr. a trustee for the Benefit of his children both born and to be born, to use manage and controll said bequeath during his natural life free from the interference of any one, and I hereby invest the said Bartlett with power to sell exchange charge or dispose of any and all of said property either real or personal as to him shall seem best to the interest of his children and in case of the death of the said Bartlett Jones Jr. I hereby constitute William S Jones my grand son & son of said Bartlett sole trustee of said estate and successor to said Bartlett Jones Jr. in the trust imposed in this item. The said Bartlett Jones Jr. is hereby authorized to reserve from the property named; in this Item a sufficient support for himself and wife during their natural lives without accounting to anyone for the same and he is hereby empowered to manage or dispose of said property to procure said support and in case the said Bartlett shall die leaving him surviving a widow the successor of Bartlett or trustee of said estate shall provide a comfortable support for the said widow out of the aforesaid property during her life.

Item 3rd I give devise and bequeath to my son Sillick Jones and his heirs the sum of five ($5) dollars in good and currant money.

Item 4th I give to my son Timothy Jones during his natural life the tract of land whereon he now lives and at his death I give devise and bequeath the said tract of land to the children of my son Timothy Jones their heirs and assigns but the said Timothy shall have no power to chance or dispose of the same longer than during his natural life.

Item 5th I give to the children of my son Benjamin Jones the sum of five dollars ($5) in good and currant to be paid by executors in equal amounties.

Item 6th I give devise and bequeath to my daughters Angilico and Roxy Ann and their heirs the tract of land upon which I now live. I also give to each of them one bed & bed stead & furniture and one cow and calf to be selected by each of them from any of my beds and cattle.

Item 7th I give devise and bequeath unto my Grandson Benjamin A. Cohoon one bed bed stead and furniture and one cow and calf to be selected by him after my daughter Angilico and Roxy Ann have made their choice.

Item 8th It is my will and desire that all of my personal estate not herein disposal of be sold by my Executors and out of the Proceeds thereof I give to my deceased daughter Elizabeth Cahoons heirs one hundred dollars ($100) of good and lawful money to be paid by my executors in equal proportions that is to say twenty five dollars each to the children of my deceased daughter namely Charles E Cohoon, Ellis R Cahoon, George B Cahoon and John Cahoon to be paid to them as they severally come twenty one years of age by my Executors. And the ballance of this money id any I wish to divided among all of my children.

Item 9th I hereby nominate constitute and appoint my (?) and faithful sons Bartlett Jones and Sillick Jones my Executors to carry out this my last will and testament. In testimony whereof I have hereunto set my hand and fixed my Seal this 13th day of December 1877

The forgoing will was signed & sealed by Bartlett Jones Senior in the presence of Each of us as his last will and testament and at the request of said testator we witnessed it in his presence this 13th day of December 1877

In the Probate Court

A paper writing purporting to be the last will and testament of Bartlett Jones Sen. Deceased is exhibited before me the undersigned Judge of Probate in and for the county of Tyrrell by B. Jones Jr. one of the Executors therein named and it appearing to the court that notice has been served upon the court and show cause if amy they can why said will and testament should not be admitted to Probate and the due execution thereof by the said Bartlett Jones Sr by the oath of J. R. Richardson and W. H. H Cooper the subscribing witness thence who being duly sworn doth dispose and say and each for himself deposeth and saith that he is a subscribing witness to the paper writing now shown here purporting to be the last will and testament of Bartlett Jones Senior Deceased that the said Bartlett Jones Senior in the presence of these deponants subscribed his name at the end of said paper writing which is now shown as aforesaid and which bears date on the 13th day of December AD 1877 And deponant further saith that the said Bartlett Jones Sr the testator aforesaid did at the time of subscribing his name as aforesaid declared the said paper writing subscribed by him and exhibited to be his last will and testament and these deponants did thereupon subscribe their names at the end of said will as attesting witnesses thereto and at the request and in the presence of the said testator. And these deponants further saith that at the said time when the testator subscribed his name to the said last will and testament as aforesaid and at the time of the deponants subscribing their names as attesting witnesses thereto as aforesaid the said Bartlett Jones Sen. was of sound mind and memory of full age to execute a will and was not under any restraint to knowledge information or belief of these deponants and further these deponants saith not.
