In the name of God Amen the sixteenth day of January 1735/6 I Robt. Hill of Terril Precinct & province of North Carolina plantors being very sick & weak in body but of perfect mind & memory Thanks be given unto God Therefore calling unto mind ye mortality of my body & knowing that it is appointed for all men once to dye do make & ordain this my Last will & testament that is to say principally & first of all I give & recommend my Soul into ye hands of God that gave it & my body I recommend to ye Earth to be buried in decent Christian burial at ye discretion of my Executors nothing doubting but at ye general Resurrection I shall receive ye same again by ye mighty power of God & as touching such Worldly Estate wherewith it hath pleased God to bless me in this Life ....(page torn - ½ line missing).... manner & form.

Imprimis - I give & bequeath to my beloved wife Ann & my son Robt.& Sarah my daughter all my stock of cattell to be equally divided.

Item - I give & bequeath to my son Robert my land & plantation which I now dwell on but ye said Robert my son to pay my daughter Sarrah two hundred pounds curr. Money at ye day of marriage.

Item - I will give & bequeath to my beloved wife & children all my moveable effects of household goods & books(?).

Item - I will that my loveing friend Paul Tharp to live upon ye said plantation & to be allowed my Craft one negro & one horse with ye bennifit of ye cattle till such time my son Robt comes of age on condition for his paying two hundred & twenty five pounds yearly to my wife Ann.

Item - I will & bequeath my beloved friends Cullen Pollock & Robt. Ward(?) ...... Do constitute make ......(page torn - line missing)...... & moveables & I do hereby utterly disallow & disannull all other former testaments wills Legacies & bequests & Executors by me in any way before named confirming this & no other to be my last will & Testament in Wittness whereof I have hereunto set my hand & seal the day & year above written

Came before me Samuel Durrance and made oath that he saw Robert Hill sign seal & publish the above as his last will and testament and that he was at that time of sound and perfect mind & memory.

September Session 1737

On a complaint made to this court against William Davis for wasting and destroying the estate of Robert Hill deceased. Ordered that the Marshal take the said Davis into custody til he enter into bond and security for the same in the sum of five hundred pounds. Vca.

December Session 1737

An inventory of ye estate of Robt. Hill decd. exhibited into court proved before Stevens Lee as also a bond.

March Session 1738

It is ordered by this court that William Roads do give security to this court for the estate of the children of Robert Hill deceased & that Ann Davis widow of the late deceased do procure another sufficient security along with him before the bond be signed. And it is further ordered by the court that no entry be made upon the estate of the sd. Hill till sufficient security be given. And then it is further ordered by the sd. court that after sufficient security given the estate to be divided according to the intent of the will of the said Hill.

It is ordered by this court the Robert Hill, the son of Robert Hill deceased be bound out to William Roads with ye? an orphan of three? years old an above be bound out to William Roads with the consent of Ann Davis mother of the sd. child till he attain the age of one an twenty years & that the sd. William Roads shall teach or cause him to be taught to read & write & to bring him up to the occupation of a cooper. And it is further ordered that the clerk do make out his indenture accordingly.

June Session 1738

It is ordered that Ann Davis appear at the next court and give security for the estate of ye orphans of Robt. Hill decd. Vca.

September Session 1738

Ordered that Mr. William Roads do take the estate of Robert Hill deceased into his hands & give security for the same to the next court. And that Daniel Garret, Benjamin Blount be appointed to divide the estate of the sd. Robt. Hill according to the intent of the sd. Hill.

June Session 1739

Division of the estate of Robert Hill deceased returned and filed.

On motion made to this court by Mr. William Rhoad praying to expose to sales at publick vandue such part of the estate of Henry Hill deceased as will sattisfie and pay his just debts. The court haveing fully considered the same grants the same, and that they make return of the account of sales upon oath to the next court. [Should read Robert Hill, not Henry Hill. There is a subsequent duplicate entry that is crossed out that says Robert Hill]

September Session 1739

And the said William Roads gave bond in open court likewise for his due performance of his guardian of the orphans of the aforesd. Robert Hill deceased.

Blunt, Daniel Garrett, Willm. Stealy, Matthew Adams. Willm Ray, Mathew Adams Junr., Saml. Durrance, Thos. Adams, Willm. Rhoades, John Worley & John Akerman. Signed by Willm. Rhoades.

Guardian bond dated 5 Sep 1739 in the amount of two hundred and fifty pounds appointing William Roads guardian of the children of Robert Hill vizt. Robert Hill & Sarah Hill with Jacob Blount & John Stancil securities. with Thomas Lee & John Chesson securities.

Guardian bond dated 19 Apr 1743 in the amount of five hundred pounds appointing Jasper Hardeson guardian of Sarah Hill with Thomas Lee & John Chesson securities.
