In the name of God Amen: I Daniel Garrett of the County of Tyrrell in ye Province of North Carolina planter being of sound and disposing memory do make and ordain this my last Will and Testament in manner and form following (that is to say)

First I give and Bequeath to my son Thomas Garrett five shillings sterling money of Great Britain.

Item - I give to my son Daniel Garrett one hundred acres of land more or less lying upon the head of the Pine Ridge tract and runing down the main Dismal to a place knowne by the name of the Dogwood farm thence up ye branch to a large pine and form thence to a Reed Oak in the main line.

Item - I give and bequeath to my daughter Mary Ward five shillings sterling money of Great Britain.

Item - I give and bequeath to my son James Garrett one negro man slave named Peter to him and his heirs lawfully begotten.

Item - I give devise and bequeath to my son John Garrett and to his heirs and assigns forever all the rest and residue of my Estate both real and personal of which I am now possessed or may before my death be possessed with but in case my son John should die without an heir lawfully begotten I give my Manner plantation to my grandson Daniel Garrett.

Item - I give to Thomas Garrett son of James Garrett half ye land lying on ye North side the Branch called ye Siprus pound lying in Balys Island beginning at the East end of ye Island and runng towards the Bever Dam.

Item - I give the other half lying on ye North side ye said Brancy to my grandson Daniel Ward.

Item - I give my grandson Steven Corprew all the land lying on ye South side ye sd. Branch in the said Island.

Item - I give to my Grandson William Garrett son of Daniel Garrett ye Pine Ridge plantation with all the land belonging to itt.

Item - And I will that if my son John die without an heir lawfully begotten that all my moveable Estate be eaqually divided between my six chaildren to wit: Thomas Garrett Daniel Garrett Mary Ward Joanah Corprew Elizabeth Rhodes James Garrett.

Lastly - I nomenate and appoint my son John Garrett sole Executor of this my last Will and Testament hereby revoaking annulling and making void all other Wills and Testaments by me heretofore made. In witness wereof I have hereunto set my hand and seal the fourteeth day of January in the year of our Lord Christ one thousand seven hundred and fifty eight.

June Session 1761

Personally appeare Thomas Harrison and on his oath proved the last will and testament of Daniel Garrett Senr. & that he saw the other two witnesses Nathaniel Everett & Benjmin Blunt Esqr. sign as witnesses on motion ordered recorde.

Personally appeared John Garrett and qualified executor of the last will and testament of Daniel Garrett deceased by taking the oath appointed for executors.
