Dated May 2, 1710

In the name of God amen I James Fewox being ? both in mind body & health praise be to God for the same but considering the uncertainty of this ? mortall life; and being willing to dispose of the worldly estate which God hath blest me with and to settle my other worldly affairs do give and bequeath my sole to God who gave it & my body to ye earth to be buryd according to that decency that my executors hereafter named shall think meet & convenient do herein constitute and appoint this my last will and testament revoking & disannul all other wills & testaments whether berball or writen.

Imprimis I give & bequeath unto my son Robt. Fewox all the cattle which he hath in his possession with one black brooding mare known by the name of Spright and all the land that he now lives upon from a slash on the south side of his now dwelling house running northyly to a place called Phelps his Swamp to him & his heirs forever.

Item - I do give & bequeath unto Jno. Lawson one young horse branded with JF upon the rear buttock and I do further give & bequeath unto him one hundred acres of land be the same more or less with these bounds viz. from a place called Mahomets Swamp to Wm. Hardy's line.

Item - I do give & bequeath unto Samm Hardy son of Wm. Hardy one two year old heiffor.

Item - I do give & bequeath to my wife Ann Fewox five pounds yearly durying her naturall life.

Item - I do give & bequeath the plantation I now live upon to Mary Lawson widow & relict of Nathaniel Lawson deceased for her natural life @ whome I do nominate & appoint my executrix and to whome I leave all my whole estate both real and personalty excepting the above mentioned legacys land and plantation which I now live upon afterward the same I do give & bequeath the same unto my son Robt. Fewox & his heirs forever & by defalt of male heirs to next heirs at law. Witness my hand & seal this second day of May Anno Domini 1710

Codicil to the above will written on the back side and dated 5 May 1711


V upon the other side what gift I have given I do confirm and no ways disannul. But for ye use & comfort of the familys viz. my son Robt. Fewox & Jno Lawson & Mary Lawson it is my will and desire that ye mill wch is now fixt may go for the use & comfort of ye said three famalys for them all to have equall priviladge to grind at ? and the longest liven of ye said three famalys to have & possess her wholy as also if ye daughter of Mary Lawson shall marry & loat in this {neck town ?} she to enjoy the same priviladges of ye mill with ye ? above mentioned. Confirmed with my hand & seal May ye 5th 1711.
