In the name of God Amen, I Enoch Fagan of the County and Province aforesaid being infirm of body but of sound dispossing mind and memory thanks be given to Allmighty God for the same do this sixteenth day of January one thousand seven hundred and seventy seven make and publish this my last will and Testament in manner and form following That is to say

Imprimis - First I recommend my Soul into the hands of allmigty God that gave it to me and my body to the Earth to be decently buried at the discression of my Executors hereafter named

Item - I lend unto my dearly beloved wife Ruina(?) Fagan all my land and tennements during her widowhood or natural life and at her decease or day of marrage I give the said lands and tennements unto my deblved daughter Mary Fagan to her and her heirs lawfully begotten forever

Item - I give unto my loving wife Ruina Fagan one horse called Dolphin and one single riding chair

Item - I give and bequeath unto my wife Ruina Fagan and my beloved daughter Mary Fagan so arriving by such sail to be putt out to in trust and if my said daughter Mary Fagan should die without heirs lawfully begotten of her body my will and desire is that every part and parcel of her estate shall resend or fall to my wife Ruina Fagan to her and her heirs forever.

Item - I will that the Lagacy left in my Fathers will to my mother Sarah Fagan after her decease or marrage to desend or fall to my beloved daughter Mary Fagan after the death or marrage of the said Sarah Fagan to her and her heirs forever.

And I make constitute and ordain my beloved wife Ruina Fagan Executors and my good friend Benjamin Blount Esqr. And Gray Judkins executors of this my Last will and Testament Revoaking and disanulling all other or former Will or Wills and Testaments heretofore by me made constituting and confirming this and no other contained on this one sheet of paper to be and contain my last will and Testament in witness whereof I have hereunto sett my hand and seal in the presence of each of the witnesses hereto subscribed this day and year first above written.

State of North Carolina

I Richard Caswell Esqr. Governor of the said State do hereby certify that the within Last Will and Testament of Enoch Fagan late of Tyrrel County Deceased was produced before me and proved by the oath of Francis Ward a subscribing witness thereto who swore that he saw the Testator sign seal publish & declare the same to be his Last Will & Testament, that he was then of sound & disposing mind & memory and that he also saw Samuel Black & Isham Webb sign as concurring witnesses with him. At the same time Runia Fagan & Gray Judkins Executrix & Executor in the said Will named appeared & qualified as such. Of the primipu the Secretary is required to take notice of issue Letters Testamentory accordingly.

Given under my hand at New Bern the 29th day of April Amo Dom 1777.
