January Session 1821

Administration on the estate of James Etheridge was committed to Alfred Burgess who entered into bond with approved security & quallified according to law Ordered that letters of administration issue thereon & that he proceed to sell the perishable estate of said deceased and account for the same as the law directs.

July Session 1821

Inventory & account sales of the estate of James Etheridge deceased was returned in open court on oath by the administrator & filed.

October Session 1821

Ordered that Enoch Hassell John Bryan & Richard Howett be appointed to audite & settle the estate of James Etheridge deceased & make report to the next term.

January Session 1822

Ordered that Enoch Hassell John Bryan & Richard Howett be appointed to audite & settle the estate of James Etheridge & make report to next term.

April Session 1822

Report of auditors on the estate of James Etheridge 7 appears a ballance due the administrator of $27.74 was returned to court & filed.

Bond dated 2 Jan 1821 in the amount of five hundred dollars appointing Alfred Burgess administrator of the estate of James Etheridge Senr. deceased, Allen Howett & Zebulon Tarkinton securities.

Petition at the Court term on the first Monday after the fourth Monday in June 1821 by Alfred Burgess who states that James Etheridge died intestate and at the time of his death was indebted to your petitioner in right of his wife Polly the sum of $245.26 & interest from March 1815 and your petitioner is the purchaser of a like sum of $245.26 & interest of James Etheridge Junr. and took out letters of administration on the estate of James Etheridge Senr. as the greatest creditor of said James at the January Term 1821. He has been unable to find personal estate of the said James to satisfy all or any part of his debts. Your petitioner has heard and believes that the said James died seized and possessed or having a real interest in & to lands and tenements which on his death descended to James Etheridge Junr. and Archibald Etheridge and to Polly wife of your petitioner. These lands or real estate ought to be and are liable to your petitioners debt. Petitioner requests that copies of this petition be served upon the said James Etheridge and heirs of the said James Etheridge to show cause why the real estate descended to him should not be made liable to his said claims.

Answer of James Etheridge & Archibald Etheridge to the petition of Alfred Burgess at the Court term on the first Monday. Defendants admit that their father James Etheridge was indebted to the petitioner in right of his wife Polly for $245.26 plus interest from 9 January 1815 and that James Etheridge their father was indebted to your respondent James a like sum of $245.26 plus interest from 9 January 1815 and that the said Burgess bought the last mentioned sum of your respondent James and is entitled thereto. Both of these sums are due from their father as the administrator of Morris Humphreys to whose estate the said Burgess' wife Polly and your respondent were next of kin and distributees. Respondents further consent that a decree may be made in favor of the petitioner for both said sums & interest to be made out of real estate if any can be found.

Execution issued 2 Jul 1821 against the lands and tenements of James Etheridge deceased in the hands of his heirs at law, James Etheridge Junr., Archibald Etheridge & Polly Etheridge for $681.00 which Alfred Burgess recovered against them for debt and interest plus $6.00 for costs. Sheriff notes that Alfred Burgess bought all right of land for $700 which satisfied the debt.

Sale 27 Sep 1821 of the right of James Etheridge deceased to 200 acres of land valued at $3.50 per acre to Alfred Burgess for $700.

Audit of the accounts of Alfred Burgess administrator of the estate of James Etheridge with the estate on 27 Mar 1822. Balance due the administrator of $7.74.
