Dated 25 March 1822

In the name of God amen: I Richard Davis of the County of Tyrrell in the State of North Carolina being sick & weak in body but of Sound mind & memory (blessed be God) do this twenty fifth day of March in the year of our Lord one thousand eight hundred & twenty two make and publish this my last will & testament in the manner & form following that is to say ---

First of all my will & desire is that all my just debts shall be well & truly paid out of my estate I then give & bequeath to my son Willis Davis one dollar to him & his heirs forever --

I then give & bequeath to my dearly beloved daughter Sally Ann Owens one feather fed & furniture & one suit of curtains to he & her heirs forever ---

I then give & bequeath to my dearly beloved daughter Elizabeth Brickhouse one dollar to her & her Heirs forever -

I then give all the remaining part of my estate real & personal to be equally divided between my two dearly beloved sons Thomas Davis & Richard Davis to them & their heirs forever.

I also ordain nominate & appoint my two well beloved sons Thomas Davis & Richard Davis Executors to this my last will & testament. I appoint Samuel Spruill Esquire & Jeremiah H. Phelps to assist my Executors in settling my Estate & be entitled to the emoluments that the law allows executors arising from such sales equally as much so as if the had been appointed executors. I acknowledge this to be my last will & Testament and no other.

July Session 1822

The last will & testament of Richard Davis deceased was exhibited & proved in open court by the oaths of Willis Sawyer and Rachel Sawyer subscribing witnesses thereto & ordered to be recorded - (no executor quallified)

Thomas Davis & Richard Davis executors to the last will & testament of Richard Davis Senr. deceased came into open court & refused to quallify to said will & renounced their right to quallify to said will - on motion it was ordered that administration with the will annexed be granted to Joseph Halsey as the greatest creditor of the said Richd. Davis deceased & that he enter into bond with approved security in the sum of five hundred dollars for said administrator which was accordingly done & he quallified agreeable to law.

October Session 1822

Inventory of judgements & notes belonging to the estate of Richd. Davis deceased was returned in open court on oath by Joseph Halsey the administrator amount $126.23 also an account sales of the ballance of land & stock belonging to said estate was returned on oath by said administrator to amount $600.17 & filed.

Davis, Richard, 1822


Bond dated 2 Jul 1822 in the amount of two hundred and fifty pounds appointing Joseph Halsey administrator of the estate of Richard Davis deceased, Uziah Spruill & Zebulon Kemp securities.

Petition July Term 1822 by Jos. Halsey administrator of Richard Davis Senr. deceased showing that Richard Davis Senr. died in April 1822 leaving a will naming his sons, Thomas & Richard Davis as executors. The will was proved in court but the sons renounced serving as executors. Petitioner was named as administrator of the estate by virtue of being the greatest creditor. The personal property of the deceased has been exhausted by sales under different executions as well as part of the lands of said deceased. In his will, Richard Davis Senr. left all of his lands to his sons, Thomas & Richard Davis, and this land is now his only means of satisfying the debts of the estate. Petitioner prays a decree from the court to sell said lands. This is folowed by a note ackowledging service of the petition by Thomas & Richard Davis who state that they have no objection to the sale of the land.

A number of documents relating to suits attempting to recover debts owed by the estate that appear to be of no genealogical significance.
