April Session 1818

Ordered that Elizabeth Davenport have leave of administration of the estate of Azeal Davenport and has entered into bond in the sum of five hundred pounds John Alexander Thomas Weatherly securitys.

Ordered that Eliza Davenport administratrix of the estate of Azeal Davenport deceased sell the estate of said deceased agreeable to law & make return to next court.

Ordered that Joshua Swain Henry Norman Elikim Swain Enoch Hassell Esquire lay off to Fanny Davenport widow of Azeal Davenport one year allowance agree to law & make returns to the next term.

Ordered that the sheriff summon a lawful jury to go on the premises of Azeal Davenport deceased & lay off to Fanny Davenport widow of said deceased her third of land and make return to next term.

Ordered that Jesse Hassell constable bring to the next term Isaac, Thos., and Henry Davenport orphans of Asahel Davenport deceased to be dealt with as the court directs.

July Session 1818

Enoch Hassell Esquire returned into court the years allowance of Mrs. Fanny Davenport ordered file.

Inventory and account of sales of the estate of Azeal Davenport deceased was returned to court on oath by Eliza Davenport his administratrix amounting to $59.19 & filed.

The return of the thirds of the land of Azeal Davenport deceased laid off to Fanny Davenport widow of said deceased was returned to court & filed.

Ordered that Thomas Davenport be bound to John Micheaw to learn the art of farming & to read write & cypher as far as the rule of three.

Ordered that Isaac Davenport be bound an apprentice to Benjamin Brickhouse to learn the art of a wheel rite & to read write & cypher as far as the rule of three.

Ordered that Thomas Weatherly be appointed guardian to Henry Thomas Isaac Chloe (?) Jesse & Elijah orphans of Azeal Davenport & entered into bond in the sum of five hundred pounds Joseph Lucas & Richd. Roughton securitys.

July Session 1819

Robert Webster was appointed guardian to Henry, Thos. Isaac Chloe Jesse & Elijah Davenport orphans of Azael Davenport deceased who entered into bond with approved security viz., Eby Phelps & Danl. Bateman, the court ordere that each heir should be put in one bond.

October Session 1819

Account sales of the lands of Azael Davenport deceased sold by order court was returned by the sheriff amount $263 & filed.

January Session 1821

Ordered that Thomas Harris Constable produce to the next court two orphan boys named Thomas & Jesse Davenport orphans of Azael Davenport deceased in order to be dealt with as the law directs in such case provided.

January Session 1823

Ordered that see fas issue against Robert B. Webster guardian to the heirs of Azael Davenport to show cause why he should not be removed from his guardianship for mismanagement.

July Session 1827

Ordered that John B. Beasley be appointed guardian to the heirs of Azail Davenport.

Davenport, Asahel (Azael), 1818


Bond dated 13 Apr 1818 in the amount of one thousand dollars appointing Elizabeth Davenport administratrix of the estate of Asahel Davenport deceased, Thos. Weatherly Senr. & John Alexander Senr. securities.

Laying off of the years allowance to Fanny Davenport widow of Asahel Davenport out of his estate. Beside provisions, an additional $189.80 out of the estate was allowed. Dated in 1818 and returned to court in July Term 1818. Commisioners were Joshua Swain, Henry Norman & Elikem Swain.

Petition July Term 1818 by Betsy Davenport administratrix of Asahel Davenport stating that the personal property of the estate has been insufficient to meet the debts and now she is subject to a judgement for which she has no money to pay. Asahel Davenport died seized and possessed of a tract of land adjoining Benjamin Swain, Abraham Swain, William Sutton & John Ansley and left children Henry, Thomas, Isaac, Chloe, Jesse & Elijah Davenport his heirs at law and infants under the age of twenty one. Petitioner requests that a guardian be appointed for the orphans and that the court issue a subpoena against them to appear at court and either pay over the monies due from the estate or sell so much of the land as necessary to meet the debts of the estate.

Court order on the second Monday of April 1819 for the Sheriff to summon Thomas Weatherly guardian of the orphans of Asahel Davenport to the next court to show cause, if any, why the lands of the estate of Asahel Davenport should not be chargeable for the amount due the administratrix, Betsy Davenport, for debts owed by the estate.

Court order July Term 1819 for the Sheriff to sell the lands of the estate of Azael Davenport sufficient to discharge the debts of the said deceased agreeable to a petition file for that purpose.

Account of the estate of Azael Davenport with the administratrix on 6 Jul 1819. Balance due the administratrix was $524.98.

Sale 2 Oct 1819 of 115 acres on the south side of Riders Creek to Silas Etheridge for $230 and another 100 acres to Silas Etheridge for $33. Bonds taken and delivered to Elizabeth Davenport administratrix.

Execution dated 30 Sep 1822 against the lands of Azail Davenport deceased in the hands of his heirs to satisfy a judgement for $577.38 and $6.50 in costs obtained by Elizabeth Davenport.

Court orders 31 Mar 1823, 30 Jun 1823 & 30 Dec 1823 that the Sheriff summon Robert Webster guardian to the heirs of Azail Davenport to appear at the next term of court to show cause why he should not be removed from his guardianship for mismanagement.

Bond dated 25 Jul 1827 in the amount of two hundred pounds appointing John B. Beasly guardian of Chloe, Isaac & Elijah Davenport, minor orphans, Joseph Hallsey & W. B. Hodges securities.
