I, C. H. Davenport of the County of Tyrrell and State of North Carolina being of sound mind but considering the uncertainty of my earthly existence, do make and decide this my last Will and Testament.

Item - My executrix hereinafter named shall give my body a decent burial suitable to the wishes of my friends and relatives and pay all funeral expenses togeather with all my just debts out of the first moneys which may come into her hands belonging to my estate.

Item - I give and devise to my beloved wife all of my personal and real estate during her natural life and at her death all of the real and personal property is to be equally divided between mine and her children. I empower her with the priviledge of selling any of the timber that may be grown on my land during her life for her support or the childrens support or education or for the purpose of keeping up the farm and making such changes in the personal property as may be needed.

Item - I hereby constitute and appoint my beloved wife, Anna May Davenport, my lawful executrix to all intents and purposes to execute this my last Will and Testament, to serve without bond according to the true intent and meaning of the same and every part and clause thereof hereby revoking and declaring as utterly void all other Wills and Testaments by me heretofore made.

In witness whereof, I the said C. H. Davenport do hereto set my hand and seal this the 4th day of January, 1919.

Signed, sealed, published and declared by the said C. H. Davenport to be his last Will and Testament in the presence of us, who in his presence and at his request, and in the presence of each other have hereto set our names as subscribing witnesses thereto.

A paper purporting to be the last Will and Testament of C. H. Davenport deceased, is exhibited before me, the undersigned Clerk of the Superior Court for the said county, by Mrs. Anna May Davenport the executrix therein mentioned; and the due execution thereof by the said C. H. Davenport by the oath and examination of I. H. Davenport and H. T. Davenport the subscribing witnesses thereto, who being duly sworn doth depose and say, and each for himself deposeth and saith that he is a subscribing witness to the paper writing now shown him purporting to be the last Will and Testament of the said C. H. Davenport which bears the date of 4th day of January 1919. And this deponent further saith that at the same time when the said testator subscribed his name and at the time of the said deponents subscribing his name as a attesting witness thereto the said C. H. Davenport was of sound mind and memory, of full age to execute a Will and was not under any restraint to the knowledge, information or belief of this deponent: And further these deponents say not.

It is therefore considered and adjudged by the Court that the said paper writing and every part thereof is the last Will and Testament of C. H. Davenport, deceased, and it is ordered that the same with the foregoing examination and this certification be recorded and filed.
