Dated 22 October 1880


In the name of God Amen. I Isaac H DAvenport of the County of Tyrrell and state of North Carolina do hereby make and declare this to be my last will and testament in manner and form following

Item 1st I give bequeath and devise to my beloved son Gilford L. Davenport to him his heirs and assigns the following described tracts of Land. It being the tract whereon I now reside and bounded as follows Beginning at Shell Landing on the Scuppernong River then westwardly the edge of the swamp low water mark then the various courses of the swamp to my road to two pines Stumps thence westwardly along said road to the head of the old ditch then along said ditch and swamp Northwardly to the river then southwardly along the old Patent line to the Begining. Containing Eighty five acres more or less to have and to hold to him the said Gilford L. Davenport his heirs & assigns. I also give and bequeath to my beloved son Gilford L Davenport all of my personal property of every nature and Kind.

Item 2nd I give bequeath and devise to my beloved son Isaac H Davenport all the ballance of my land containing Eighty five acres more or less to have and to hold to him the said Isaac H Davenport his heirs and assigns

Item 3d I give and bequeath to my beloved Daughter Nancy Davenport two hundred and fifty dollars in money to be paid to her by my son Gilford L Davenport within one year from and after the day my son Isaac H Davenport becomes twenty one years of age, there is to be no interest paid by him on this bequeath. Simply the Two hundred and fifty dollars and this bequest is to be a charge on the property given to my son Gilford L Davenport in the 1st Item of this my last will and testament


Item 4th I give and bequeath to my daughter Mary Margrett Davenport Fifty dollars to be paid to her by my son Gilford L Davenport with in one year from and after the day my son Isaac H Davenport becomes twenty one years of age without interest and to be a charge upon the property given to my son Gilford L Davenport in Item one of this my last will and testament.


Item 5th I hereby constitute and appoint my son Gilford L Davenport Guardian of both the person and property of my son Isaac H Davenport until he arrived at the age of twenty one years. And he the said Gilford L Davenport is use rents and proffits arising from the Lands given to my said Isaac H Davenport in Item 2d of this my last will and testament in taking care of and educating him the said Isaac H. Davenport as he the said Gilford L Davenport may think best no bond is to be required.


Item 6th I desire that my executor hereinafter named have my body properly buried and that he pay all of Just debts


Item 7th I hereby constitute and appoints my beloved son Gilford L. Davenport my true and lawful Executor to Execute this my last will and testament according to the true intent and meaning hereof In witness whereof I have hereto set my hand and affixed my seal this 22d day of October AD 1880.

In the Probate Court

A paper writing purporting to be the last will and testament of Isaac H Davenport deceased is exhibited before me the undersigned Judge of Probate in and for said County by Gilford L Davenport the executor therein named and the due execution thereof by the said Isaac H Davenport by the oath and examination of James O Mydgett and W. G. Colstan two of the subscribing witnesses thereto who being duly sworn doth depose and say and each for himself deposeth and saith that his is a subscribing witness to the paper writing now shown him purporting to be last will and testament of Isaac H Davenport that the said Isaac H Davenport in the presence of this deponant subscribed his name at the end of said paper writing which is now shown as aforesaid and which bears date 22d day of October 1880 and the deponant further says that the said Isaac H Davenport the testator aforesaid did at the time of subscribing his name as aforesaid declared the said paper writing so scribed by him and exhibited to be his last will and testament and this deponant did thereupon subscribe his name at the end of said will as an attesting witness thereto and at the request and in the presence of the said testator and this deponant further saith that at said time when said testator subscribed his name to the said Last will as aforesaid and at the time of the deponant subscribing his name as an attesting witness thereto as aforesaid Isaac H Davenport was of Sound mind and memory of full age to execute a will and was not under any restriction to the knowledge information and belief of this deponant and further these deponants says not
