I Lewis Davenport of the County of Tyrrell and State of North Carolina being of sound mind and memory but considering the uncertainty of my earthly existence do make and declare this to be my last will and testament in manner and form following that is to say; First that my executor thereinafter named, shall provide for my body a decent burial and pay all further expenses together with Just debts how soever and to whomsoever owing out of the monies that first come into his hands.

Item I give and devise to my friend John A Pledger all of my estate both real and personal. And lastly I do hereby constitute and appoint my friend John A Pledger my lawful executor to this my last will and testament. In witness whereof I the said Lewis Davenport do hereunto set my hand and seal. this 24th Sept 1868

The anexed paper writing purporting to be the last will and testament of Lewis Davenport is exhibited into the Probate Court by John A Pledger appointed therein as executor and with John Spruill and W, R. Spruill as witnesses thereto who being duly sworn each for himself deposes and says as follows the John Spruill says that he signed said will at the request of the said Lewis Davenport and that in his presence he saw the said Lewis Davenport sign the same and declare it to be his last will and testament and the said W. R. Spruill on oath says that in presence of and at the request of the said Lewis Davenport he signed said paper writing or will and that said Davenport declared the same to be his last will and testament for the purpose therein expressed.
