In the name of God Amen: I Richard Davenport of the County of Tyrrell State of North Carolina being of sound mind & body but mindful of the uncertainty of human life and the certainty of death do make and declare this my last will and testament in manner and form as follows, and first I commend my body to the earth and my spirit to God who gave it hoping and trusting that it will be received in mercy & as to my worldly affairs my will is.

First - That after my decease my funeral charges & just debts shall be out of the first moneys that shall come into the hands of my executor or executors herein after named.

Second - Should I marry hereafter I give and bequeath to my wife during her natural life one half of all of my property not otherwise herein disposed of of every discription including land money bonds notes &c. Said property to return to my son Llewellen at her death.

Third - I give and bequeath to my son Llewellen W. Davenport to him and his heirs forever upon his arriving at the age of twenty one years the other of all of my property of every discription including land money bonds notes &c.

Fourth - Should I never marry I give & bequeath to my son Llewylleyn W. Davenport to him & his heirs forever upon his ariving at the age of twenty one years all of my property of every description including land money & notes &c.

Fifth - Should my son Llewyllyn W. Davenport die before he arives at the age of twenty one years I give & bequeath all the property of every description he may heir from me to Edward S. Davenport to him and his heirs forever and not to his (Llewyllyn) next of kin upon his mothers side.

Sixth - I do hereby appoint Edward S. Davenport guardian to my son Llewyellen strictly requesting & enjoining it upon him to give my son a thorough & liberal education & requesting him to execute & faithful & friendly care of him in all respects.

Seventh - I do hereby appoint my trusty friends Edward S. Davenport & Wil D.Cooper lawful executors to all intent & purposes to execute this my last will & testament revoky all other wills & testaments by me heretofore made; In testimony whereof I the said Richard Davenport do hereunto set my hand & seal the 23d January A D 1866.

The foregoing paper writing purpoting to be the last will and testament of Richard Davenport,

said Richard Davenport is proved by the examinations of S.M. Alexander and E. Ranson the subscribing witness thereto who swore that they at the request of the testator and in his presence saw him sign and witness the same it is therefore considered by the court that the said paper writing & every part thereof is the last will and testament of the said Richard Davenport & the same is ordered to be recorded & filed and therefore the said Edward S. Davenport & Willis D. Cooper executors as aforesaid duly qualify as such by taking the oath required bv law.
