In the name of God Amen. I, John Davenport of the County of Tyrrell in the state of North Carolina, being sick & weak in body but of sound mind and perfect memory blessed be God do this 29th of March in the year of our Lord one thousand eight hundred & eighteen make and publish this my last will & testament in manner & form following - -

First I give and bequeath to my well beloved sisters and the heirs of my brother Sahel Davenport all my landed estate left me by the will of my father to be equally divided between Charlotte Davenport, Selah Chapman & Mariam Cooper and the heirs of my brother Sahel Davenport so that the heirs of the said Sahel Davenport have one fourth of the above mentioned land - -

I give and bequeath to my well beloved uncle John Davenport one mare and all the hogs I have over there in his possession - -

I allso leave all the remainder of my estate to be sold at six months creadit and the moneys arising there from to be equally divided between my dearly beloved sisters & the heirs of my brother Sahel Davenport viz. Charlotte, Selah, Marium & the heirs of Sahel Davenport, (as in the the land) after all my just debts is paid

I also nominate constitute and appoint my friend Jeremiah H. Phelps my whole & soul executor to this my last will and testament - and furthermore I revoke, disallow and disannul any other will but acknowledge this and no other to be my last will and testament in witness of the same I have hereunto set my hand and seal the day and date above writen - -

April Session 1818

The last will and testament of Jno. Davenport deceased was proved in open court by the oaths of Jno. Snell and James Handcock & ordered recorded.

Jeremiah Phelps Senr. qualified in open court executor to the last will and testament of Jno. Davenport deceased.

Ordered that Jeremiah Phelps executor of Jno. Davenport deceased have leave to sell the perishable estate of said deceased & make returns to next court.

July Session 1818

Jeremiah Phelps executor of J. Davenport deceased returned in court the inventory & account of sales of the estate of said deceased ordered filed.

April Session 1819

Surplus account of sales of estate of John Davenport deceased by Jeremiah H. Phelps executor was returned on oath & filed.

April Session 1820

The division of the lands of John Davenport deceased was returned to court by Robert Webster & filed.

Ordered that James Wood John Haughton & Wilson B. Hodges be appointed to audite & settle the estate of John Davenport deceased with his executors & make report to next term.

July Session 1820

Ordered that John Haughton Wilson B. Hodges & James Wood be appointed to audite & settle the estate of John Davenport Junr. with his executor & make report to the next term.

October Session 1820

Wilson B. Hodges returned the audited accounts of the estate of Jno. Davenport deceased balance due the estate of six hundred and sixty two dollars and six & half cents.

Petition January term 1820 by John Cooper & Mariam, his wife stating that John Davenport made his will in due form of law devising to Mariam Davenport, since intermarried with John Cooper, part of a tract of 400 acres joining Silas Etheridge and Robert Webster. This tract was also devised equally to Cela & Charlotte, sisters of Mariam and also to the heirs of Azeal Davenport who are Henry Thomas Isaac Chloe Jesse & Elijah, infants represented by their guardian Robert Webster. Pray a commission be appointed and the land be divided.
