April Session 1817

The last will and testament of Isaac Davenport was exhibited into open court and proved by the oath of Abner Alexander and filed.

Elizabeth Davenport came into open court and quallified as executrix to the last will & testament of Isaac Davenport deceased in due form of law.

Ordered that Elizabeth Davenport executrix to the estate of Isaac Davenport deceased sell the perishable estate of the said deceased agreeable to law & make return to the next term.

July Session 1817

The inventory and account of sales of Isaac Davenport was returned to court on oath by Elizabeth Davenport the administratrix & filed.

October Session 1817

Ordered that Robert Webster Major Brickhouse John Meekins Abner Alexander & Jesse Alexander be appointed with Rodger Snell surveyor to divide the lands of Isaac Davenport deceased agreeable to his last will and testament & make return to next term.

April Session 1819

Ordered that Richd. Wood Wilson B. Hodges & Daniel Bateman be appointed to audite & settle the estate of Isaac Davenport deceased with the administrator & make report to next term.

July Session 1819

Report of auditors on the estate of Isaac Davenport was returned in open court & filed.

October Session 1829

Elizabeth Davenport executrix of Isaac Davenport returned account sales of negro Mack & filed.

Document dated 1812 in Admiralty. To the hororable Henry Potter Judge of the District Court of the United States for the North Carolina District and from Robert H. Jones Attorney of the United States for the North Carolina District. Statement that the Collector of Customs for the Edenton District in the District of North Carolina on 5 Feb 1812 arrested and seized at Edenton the vessel Maria as forfeited to the United States. It's master was Benjamin Jackson and it was seized for importing one hogshead of rum, one barrell of sugar, one barrel of coffee and a quantity of oranges from the island of Jamaica, a dependency of Great Britain, contrary to the laws of the United States and with the knowledge of the said master. Attorney requests that a court date be set and all interested parties be summoned to show cause, if any, why the Maria should not be condemned and sold

Isaac Davenport makes an undated plea of trespass against Elihu Hunnings who was mate with a mate's authority on the schooner Maria owned by Isaac Davenport. While in the West Indies preparing to return to the United States and under the command of Elihu Hunnings the said mate procured a hogshead of rum despite knowing that a law had been passed prohibiting the importation of rum from the English West Indies with a penalty of seizure and forfeiture of the vessel. He returned to Alligator River in North Carolina with the rum, where the vessel was seized and forfeited to the damage of Isaac Davenport.

Summons dated 4 Jul 1817 indicates that Jesse Alexander and Elizabeth Davenport were executor and executrix of the will of Isaac Davenport deceased.

Indenture dated 10 June 1817 between Elizabeth Davenport executrix of the estate of Isaac Davenport deceased on the one part and Clement H. Blount, James Iredell & John B. Beasley of Chowan County and Burton Hathaway of Tyrrell County on the other part. Per provisions in the will of Isaac Davenport a certain fishery and fishing grounds on Scuppernong River between Rock Creek and Road Landing including one hundred and fifty feet back from the river are leased for twelve years at sixty dollars per year. It is further agreed that within twelve months the lessors shall erect on the said premises at their own cost a fish house fifty feet by thirty four feet, a salt house twenty feet by sixteen feet, both framed, and a framed dwelling house thirty feet by twenty feet with a plank floor and a chimney in the middle.

Undated calculation of the $60 annual rent and interest due from Clement H. Blount, James Iredell & John B. Beasley from 10 Jun 1818, the end of the first year of a lease to 10 Jun 1829. Total principal is $720 plus $266.20 in interest if no payments were made, totalling $986.20. Payments listed are $192.60 on 15 Apr 1822 and $150 on 29 Aug 1826, with saved interest of $89.70 and $30.77, for a total credit of $463.07, and leaving a balance of $513.23 yet due in principal and interest. The value of buildings is also listed as $350 and there is a total of $863.23.

Summons issued 27 Jul 1829 for James Iredell, Clement H. Blount, John B. Beasley & Burton Hathaway to appear at the next court term to answer to Elizabeth Davenport executrix of Isaac Davenport in a plea of covenants broken to her damage of fifteen hundred dollars.

Summons issued 27 Oct 1829 for Joseph Snell to attend court and testify in a suit in which Elizabeth Davenport executrix of Isaac Davenport is plaintiff and James Iredell, Clement H. Blount & Burton Hathaway are defendants.

Summons issued 23 Aug 1831 for James Iredell & Clement H. Blount to appear at the next term of court and satisfy a judgement for $863.23 and costs of $15.72 which Elizabeth Davenport executrix recovered in a suit against them.

Executions dated 27 Jan 1830, 10 Nov 1837 & 20 Aug 1838 against James Iredell & Clement H. Blount for one hundred and sixty dollars plus twenty two dollars in costs and damages which Elizabeth Davenport executrix of Isaac Davenport recovered against them on 27 Jan 1830.

Execution dated January Term 1839 just against Clement H. Blount.

There are many other documents dealing with the above suit and other suits wherein the executrix of Isaac Davenport is attempting to recover debts due the estate. They do not appear to be of genealogical significance.
