Dated 9 November 1820

In the name of God amen: 9th day of November in the year of our Lord 1820 I Thomas Crain in the said County being sick and weak in body, but of perfect mind & memory thanks be given to Almighty God therefore calling unto mind the mortality of my body & knowing it is appointed that is to say principaly & first of all I give & recomend my soul into the hands of God that gave it and my body to be buried in a Christian like manner ---

1st - My will & desire is that my wife Elizabeth shall possess all my property as it doth now stand to her own use & disposal during life or widowhood.

2d - My will & desire is that the plantation where I now live to may two sons William Crain & John Crain.

3d - My will & desire is that my part of the land lying amongst the heirs of Benjm. Tweedy desd. to my son Thomas Crain.

4th - My will & desire that my two sons William & John Crain shall pay unto my son Thomas Crain the sum of forty dollars twenty dollars each.

5th - My will & desire is that at the marriage or death of my wife Elizabeth is to say the household furniture and stock of all kinds to be equally divided amongst my girls.

6th - My will & desire is that my farming tools equal divided amongst my three sons, William John & Thomas Crain ---

I do nominate and appoint for executors this my last will & testament my wife Elizabeth and Lemuel Basnight the 9th day of November 1820.

January Session 1821

Ordered by the court that notice issue & be served upon Elizabeth Crain executrix of Thomas Crain to appear at the next court & show cause why she shall not produce the will of said Crain for probate.

April Session 1821

The last will & testament of Thomas Crain was exhibited into open court & proved by the oath of John Tweedy & Isaac Tweedy subscribing witnesses thereto, same time appeared Elizabeth Crain & quallified as executrix thereto in due form, ordered that letters testamentary issue thereon with a coppy of the will annexed.

July Session 1821

Elizabeth Crain came into open court & desented from the last will & testament of Thomas Crain deceased.

Ordered that John Thoroughgood Selby Patrick Thomas Leigh & Frederick Davenport or any three of them be appointed to audite & settle the accounts of Thomas Crain as administrator of Joseph Crain deceased & make report to next term.

Ordered that Elizabeth Crain executrix of Thomas Crain deceased be authorized and impowered to sell as much of the legacies bequeathed in the will of the said Thomas Crain as will pay the debts of the testator on a credit of six months & make return thereof.

Inventory of the estate of Thomas Crain deeased was returned to court on oath & filed.

October Session 1821

The account sales of the estate of Thomas Crain was returned in open court on oath & filed to amount $164.73.

April Session 1823

Henry Alexander sheriff returned in open court Elizabeth Crain dower in her deceased husbands land & filed.

Crane, Thomas, 1821


Summons dated 1 Jan 1821 for Elizabeth Crain executrix of Thomas Crain to appear at the next court term and show cause why she has not produced the will of said Crain for probate.

Laying off of the dower on 22 Nov 1822 of Elizabeth Crain widow of Thomas Crain deceased in a tract of fifty acres on the south side of Litle Alligator Creek. Thirteen and one third acres were allocated to the widow including the dwelling house and out houses.

A number of documents relating to a suit by Henry Alexander against John Twiddy, Elizabeth Crain administrator of Thomas Crain deceased and Ozias Roughton for debt. The documents state that Thomas Crain owned a tract of fifty acres on the south side of Little Alligator Creek joining Winneford Basnight, Samuel Johnson & Charles Johnson.


Transcriber's Notes:
The 1820 census indicates that Thomas Crane had 4 daughters who are mentioned but not named in his will.
