In the name of God Amen: The twenty first day of Fbuary in the year of our Lord Chris one thousand seven hundred and sixty and one I James Conner of Tyrrel County in the Province of North Carolina being weak of body but of perfect mind and memory and knowing that it is appinted once for all men to die therefore do make and constitute this writing to be my last Will and Testament in manner and form following and principally I recommend my soul to God who gave it and my boddy to the Earth to be buried in a decent like Burial at the duretion of my Executors herein after mentioned and as for what Worley Estate it hath pleased God to bless me with in this life I give and dispose of in manner and form following.

First - I will and desire that my lawfull debts be paid by my Executors out of my Estate.

Secondly - I will and desire Susanna Carnal and Elizabeth Carnal that is to say to Elizabeth Carnal twenty head of cattle such as appears to be due to her out of the Estate of Thomas Knight deceased and to Susanna Carnal sixteen head of cattle such as appears to be due to her out of the aforesaid Estate and likewise the ballance of money due to them out of the said Estate as by accounts may appear.

Item - I lend unto my beloved wife Charity Conner the following slaves and articles Viz: All the negroes that we are now possessed with that came by her to me by right of marrage and that my said wife have the use and labour of the said slaves during her natural life and that they be kept as slaves ought to be kept and that my said wife educate and maintain and cloath my two children Lewis and Penelope Conner out of the labour of the said slaves and after her decease I give and bequeath the said negroes and their increase to the said two children Lewis and Penelope Conner to be eaqually between them both.

Item - I give to my loving wife Charity Conner sixty head of cattle fifteen cows & calves ten yearlings five two year old heafers fifteen young stears from three to five years old also her Riding Horse and side saddle her beed and furniture also one silver cup wich did belong to her and the desk that she had herself.

I give and bequeath unto my son Lewis Conner the following particulars viz: One negro man named Pinnus Great Dinah, Phebe and Scipio and order Pinnus and the said Dianah be hired out yearly or that he keep them and be accountable to the Executors for the money arrising for their hire till he comes of age or the survisours of them and that the said Executors pay the said money to my son Lewis Conner which money I desire to be paid to the heir or heirs of Thomas Carnal deceased or so mucy of it as will discahrge sixty two pounds Virginia miney which said sum being due to the said Thomas Carnal deceased from me on account of his Fathers Estate as his Administrators reports to receive the said money of me until the heir is of age to be paid by my said son Lewis Conner without intrest as I have tendered it as he may find among my papers and if refused by the said heir or insisting to sue for a right to sum Negroes slaves that the said money may be made use of by my son Lewis Conner and my daughter Penelope defend the said suit ot the utermost of their fortune's as I am thoroughly convinced he has no right ---

Item - I give and bequeath to my son Lewis Conner that plantation that I bought of Marmaduke Norfleet on Connetoe and all the lands belonging to it also that plantation known by the name of the Indian Spruig where one Wimble lives and all the stock of cattle thereon and all the land belonging to it as also the plantation whereon John Jones lived on Connetoe and three hundred and fifty acres lying against his two plantations on the other side the swamp also a young stallion a silver watch and silver hilted sword being at this time lent to James McManus also a pair silver show buckells and a pair of silver nee buckells ---

I give unto my daughter Penelope Conner the following slaves viz: Dowdy Violet, Fanney, and Fatty also that plantation whereon John Drake did live on and also that plantation wereon George Johnston formerly lived on adjoining the Chapple land and all the lands thereunto belonging as also the stock of cattle belonging to the plantation whereon John Drake did live on also thirty head of cattle more, to be paid her out of my home stock at the home plantation in order to be put to the said plantations for her use also one young mair choice of nay belonging to me unbroke I say unto my daughter Penelope Conner to her and her heirs forever or the mair that is call hers now being a Gray mare ---

Item - I give to my daughter Rosanna Conner to her and the heirs of her body lawfully begotten the plantation and house wereon I now live and all the lands belonging to it that I hold in this neck from Mr. Jenkin Henrys line and Mr. William Everetts line so down to Mr. Ebenezer Slade line ----

Item - I give to my said daughter Rosanna Conner to her and her heirs and assigns forever a plantation whereon Edmond Oneal now lives on and all the land thereunto belonging and the stock of cattle thereon I say unto my daughter Rosanna her and her assigns forever.

Also I give to and bequeath to my said daughter Rosanna Conner that plantation whereon William Windham did live on, on Tranterrs Creek and all the land thereunto belonging which plantation being only mortgaged to me by the said Windham for a certain sum of money which when paid to my said daughter Rosanna Conner or her heirs or assigns that she or they may give him a title to the said land and plantation also I give to my said daughter Rosanna Conner the stock of hogs belonging to the said plantation ---

Item - I give unto my daughter Rosanna Conner that plantation & the land thereto belonging wereon John Edmondson lived on at Conneto and one hundred acres of land in the for of Connetoe below the plantation last mentioned I say to her her heirs and assigns forever I likewise give and bequeath unto her one hundred and fifty acres of land the lower end of a tract of land over Conntoe being part of the said tract geiven Lewis Conner over said swamp ---

Item - I give to my daughter Rosanna Conner two Great Looking Glass's which stand in the Great Roome one Mahogoney table a new desk and chest of drawers Half a dozen leather chairs in the house One of the best feather beeds and furniture in the house excepting that already given to my wife the furniture to the said beed one pair of good sheets one blanket one rug one bolster and two pillows also a certain mare called the Spade mare a side saddle and bridle and one pair of gold buttons.

Item - I give to my daughter Rosanna Conner a mullattoe wench named Hannah and a little girl name Venus them and their increase forever I say to my daughter Rosanna Conner to her and heirs and assigns forever.

Provided never the less that if my said daughter Rosanna Conner should decease without having heir as aforesaid that then I give and bequeath to my son Lewis Conner my now dwelling Plantation and all the land thereto belonging as before mentioned to him and the heirs of his body lawfully begotten forever as also the one half of the said negroes given to my Daughter Rosanna Conner I say unto my son Lewis Conner his heirs and assigns forever and the other half of the said negroes so given to my daughter Rosanna Conner I give to my daughter Penelope Conner to her, her heirs and assigns forever.

And in case my son Lewis Conner should decease without heir as before mentioned I desire that all the lands negroes and other Legacies mentioned to my daughter Rosanna Conner my be reverted to my daughter Penelope Conner under and on the same manner and condition as given to my daughter Rosanna Conner after the decease of her and said Rosanna Conner and Lewis Conner ---

Item - All the rest of my lands that is not heretofore given or sold I will and bequeath jointly to my son Lewis Conner and my daughter Penelope Conner to be sold by them and the money arrising to be equally divided between them both.

Furthermore the lands that are already sold and not yet paid for I will and desire that the moneys arrising form them may be equally divided between my three children Rosanna, Lewis and Penelope Conner.

Furthermore I will and desire that the lands and stocks given to my daughter Rosanna (Exclusive of the manner Plantation) may be equally divided between my two children Lewis and Penelope Conner (in case of the death of my daughter Rosanna Conner)

And in case my wife shold marry before my two youngest children arrive at age, or marry then my Executors take the said children and their Estates out of her hands and take proper care of them and that her husband move neither slave nor any thing of the premises that of right belongs to my said children.

I Will and desire that my Executors make a Title agreeable to the deeds and pattent to three pieces of land which I have sold to three several persons Viz: to Thomas Pearce Jesse Jernigan and one Rogers they paying the money due to me.

And in case my wife and my daughter Rosanna Conner should not agree to live togeather after my decease I Will and desire that they divide the crops of corn made at home and abroad except that at Tranters Creek which I give to Rosanna and also desire that they divide the meat provision the working oxen and horses and all the cultivation tools as plows hooes carts &c all the above mentioned articles to be divide into two equal parts the one half I Will and bequeath to my wife for her her use and my two children Lewis and Penelope Conner and the other half to my daughter Rosanna Conner and if nay sum or sums should be due to me and not already given I Will and desire when the said sum or sums are received that it may be divided between my wifre and three children Rosanna Conner Lewis and Penelope Conner ---

Item - I Will and desire that all and singular the residue of my stocks of cattle hogs horses or horse kind sheep houshold stuff of all kind which are not already given after the cattle debts are paid be equally divided by my Executors between my wife and three children my wife giving security for my two youngest childrens parts to be paid in kind when of age or married.

I Will and desire that after my decease my daughter Rosanna Conner be of age to take and receive into her own possion her part of my Estate bequeathed to her ---

Item - I Will and desire that in case my three children should die without heir that then and in such case I Will and desire that my Executors or the survivors of them may despose of my Estate so bequeathed to my three children and the neat proceeds to my brother Hugh Conner living in the city of Dublin in the Kingdom of Ireland at the sign of the Ram in Anguire Street to remit if a live if not to my Brother Michael or Peter Conner living in the County of Waxford near Gary I Will and desire it may be eaqually divided between my said three Brothers and three Sisters and if in case they should be deceased that then to -- their heirs and if in case such remitance should be made that the whole sum be equally divided between my three brothers aforesaid and my three sisters Katherne and Rose and Mary but if either of them should be deceased the part of the said deceased to be paid to his or her heirs and that there may be a copy of this Will transmitted to them or either of them is such case --

Item - I Will and desire that my daughter Rosanna Conner take into her custody after my decease the cattle due to Charles Barfield and that she be accountable to him for the same ---

Item - I give unto Partrick Meanture all my wearing cloaths except one waistcoate which I give to my son Lewis and to the said Meanture I give a horse bridle and saddle the horse that was called Smiths Horse.

I Will and desire that my daughter Rosanna continue him in her service as long as he lives he behaving well on the same terms as he lived with me that is decent cloathing sufficient for a labouring man meat drink washing & lodging if he excepts thereof.

I Will and order that my daughter Penelope pay out of her Estate the one half of the money that are due to the heirs of Thomas Carnal deceased not with standing what is heretofore mentioned in this writing.

I hereby nomenate and appoint the following persons Viz: William Hoskins Esquire of Chowan County John Campbell Thomas Whitnell William Williams of Bertie County Gentelmen and William Taylor of Halefax Esquire Executors of this my last Will and Testament and do hereby Revoak Disannull and make Void all other Wills Legacyes and Bequests by me formerly made or that may be produced by any other person or persons whatsoever excepting these presents Witness my hand and seal the day and date first above written.

Tyrrell County Court of Pleas & Quarter Sessions


June Session 1761

Personally appeared William Everett & proved upon his corporal oath the will of James Conner deceased & that he saw the other subscribing witnesses sign as witnesses & that he was of desposing mind and memory.

September Session 1761

Personally appeared William Williams and qualified one of the executors of the last will and testament of James Conner Esqr. deceased by taking the oath appointed by law.

Personally appeared William Williams and proved an inventory of the estate of James Conner Esqr. deceased. Ordered filed.

March Session 1762

Wiliam Williams Esqr. exhibited the devision of the estate of James Conner Esquire deceased and on motion ordered reorded and filed. And at the same time exhibited an additional inventory of the estate of the afsd. James Conner and proved the same on his oath ordered filed.

September Session 1764

Read the petition of William Williams & John Spear administrators of the last will and testament of James Conner esqr. deceased pray that summons issue with a copy of the petition against William Smith administrator of James Smith deceased to appear at the next court to settle the account of his administration.

Division in 1762 of the estate of Colo. James Conner agreeable to his last will and testament. Estate divided between Mrs. Charity Conner widow of the deceased Joseph John Williams who intermarried with Rosanah Conner daughter of the deceased, and Lewis Conner & Penelopy Conner children & orphans of the deceased.

Tyrrell County marriage bonds show the marriage of Charity Conner (widow) to James Matthews on 25 Jan 1767, Stevens Lee security; also the marriage of Penelope Conner (daughter of Charity Conner) to John Speir Jr. (of Pitt Co.) on 13 Mar 1764. See record for Lewis Conner who died in 1762.
