I, Allen Cahoon, of the aforesaid County and State, being of sound mind, but considering the uncertainty of my earthly existance, do make and declare this my last will and testament:

First: My executors hereinafter named shall give my body a decent burial, suitable to the wishes of my friends and relative and pay all funeral expenses together with all my debts, out of the first moneys which may come into their hands belonging to my estate.

Second: I give and devise to my beloved wife Julia M. Cahoon, Five Hundred Dollars in money from the proceeds of my personal estate to be paid over to her by my executors, the said Five Hundred Dollars is to be in full consideration of all year;s allowance, Dowers, Third or other legal rights that she might or can be entitled to in the absence of any will.

Third: I give and bequeath to my three sons, J. B. Cahoon, E. P. Cahoon, and H. W. Cahoon, and the two children of my daughter, Ida E. Sawyer, Dec'd, Ottis Sawyer and Ida E. Sawyer, all of my lands of every kind and description, to them and their heirs for ever in fee simple. that is to say, the said J. B. Cahoon, E. P. Cahoon, and H. W. Cahoon, to have one forthe each thereof, and the said Ottis and Ida E. Sawyer one forth thereof.

Forth:- It is my will and desire that all my personal property be sold by my Executors, and after paying off all the bequests in section one, and pay my said wife, Julia M. Cahoon, the Five Hundred Dollars named in section two, then the remained and every part thereof be equally divided between my three sons named in Item three of this my will, and the two children of my daughter, Ida E. Sawyer, share and share alike, giving my tow grand-children one forth there of between them.

Fifth: - My two sons, Thomas A. Cahoon and B. F. Cahoon having been provided for during my life, I make no bequeath to them in this my last will and testament.

Sixth;- I hereby appoint D. C. Sawyer, the father of the said Ottis and Ida E. Sawyer, their legal guardians, without Bond, by his receiving and receiptive for any amounts due them and make his reports, as required of Guardians, by law.

Seventh:- I hereby constitute and appoint my tow sons E. P. Cahoon and J. B. Cahoon my lawful Executors to all intents and purposes, to execute this my last will and testament according to the true intent and meaning of the same hereby revoking and declaring uterly void, all other wills and testaments by me heretofore made. In witness whereof I the said Allen Cahoon do hereto set my hand and seal this 27th day of March, 1906.

In the Superior Court- Before the Clerk.
In the matter of the will of Allen Cahoon, deceased,

the paper-writing hereto attached and purporting to be the last will and testament of Allen Cahoon, deceased, is exhibited before me the undersigned Clerk of the Superior Court of Tyrrell County, North Carolina, by E. P. Cahoon, one of the executors therein named and thereupon the following proof is taken by the oath and examination of J. I. Jones one of the subscribing witnesses thereto, and of J. I. Jones as follows:

J. I. Jones being duly sworn, deposes and says that he is a subscribing witness to the said paper-writing now shown him purporting to be the last will and testament of Allen Cahoon, and that he saw Allen Cahoon, execute this writing as his last will and testament, and that affiant attested it in the presence and at the request of said Allen Cahoon, deceased: and that at the time of its execution the said Allen Cahoon was in the affiants opinion, of sound mind and disposing memory. Affiant further swears that T. L. Jones, the other subscribing witness to said will signed the same as a witness in the presence of affiant and that affiant saw him sign same and that the said T. L. Jones is now dead.

Affidavit & Probate

W. A. G. Cahoon being duly sworn deposes and says that he is well acquainted with the handwriting of T. L. Jones, one of the subscribing witnesses to the paperwriting purporting to be the will of Allen Cahoon, deceased, which is hereto attached, dated the 27th day of March, 1906. having often seen him write, and that the name of the said T. L. Jones subscribed as a witness to the said will is in the genuine handwriting of the said T. L. Jones: the affiant further swears that he is well acquainted with handwriting of Allen Cahoon, deceased, whose will the attached paperwriting, dated the 27th day of March, 1906, purports to be, having often seen him write, and that the name of the said Allen Cahoon subscribed to the said will is in the genuine hand writing of the said Allen Cahoon.

And thereupon it is considered and adjudged by the Court that the said paperwriting and every Part thereof is the last will and testament of Allen Cahoon, Deceased, and it is ordered that the same, with the foregoing examination and the certificate be recorded and filed.
