I, S. R. Bateman Tyrrell County, North Carolina, being sound mind and disposing memory, but considering the uncertainty of my earthly existence, do make and declare this my last Will and Testament in manner and form following:

Item - My executrix hereinafter named shall give my body a decent burial, suitable to the wishes of my family, and pay all funeral expenses togeather with all my just debts out of the first moneys which may come into her hands belonging to my estate.

Item - After paying my funeral expenses and just debts as above provided for, I give, devise and bequeath to my beloved wife Sallie Bateman, all of my estate, real, personal and mixed of which I may die seized and possessed of, meaning, I hereby do give absolutely, to her and her heirs, everything which I now possess or may hereafter acquire including policies of life insurance, household and kitchen furniture, personal property of all kinds including money and real estate which I may now own or may hereafter in anyway or anywhere acquire.

Item - I hereby constitute and appoint my beloved wife Sallie Bateman, my lawful executrix for all intents and purposes to execute this my last Will and Testament according to the true intent and meaning of the same and every part and clause thereof,

hereby revoking and declaring void all other Wills and Testaments by me heretofore made. I request that my said executrix be allowed to qualify and administer my estate without giving any bond whatsoever.

In witness whereof I the said S. R. Bateman do hereto set my hand and seal this 24rd day of April 1907.

Signed,sealed, published and declared by the said S. R. Bateman to be his last Will and Testament in the presence of us, who at his request and in his presence, and in the presence of each other have hereunto subscibed our names as witnesses thereunto.

A paper, purporting to be the Last Will and Testament of S. R. Bateman deceased, is exhibited before me by Sallie Bateman, the executrix therein mentioned and the due execution thereof by the said S. R. Bateman and thereupon proven by the oath and examination of Mark Majette and A. J. Armstrong the subscribing witnessess thereto: who being duly sworn, doth depose and say, that each for himself, that the said paper-writing purporting to be the last Will and Testament of S. R. Bateman in the presence of these deponents subscribed his name at the end of said paper-writing, which is now shown as aforesaid and which bears a date of April 1907 .

And this Deponent futher saith that the said S. R. Bateman, the testator aforesaid did at the time of subscribing his name as aforesaid, declare the said paper-writing so subscribed by him and exhibited to be his last Will and Testament, and this deponent did therefore subscribe his name at the end of said Will as an attesting witness thereto, and at the request and in the presence of said testator. And this deponent further saith at the same time when the said testator subscribed his name to the said last Will aforesaid and at the time of the deponents subscribing his name as a attesting witness thereto, as aforesaid, the said S. R. Bateman was of sound mind and memory, of full age to execute a Will, and was not under any restraint to the knowledge, information or belief of this deponent. And futher these deponents say; not.

A paper-writing purporting to be the last Will and Testament of S. R. Bateman deceased, is exhibited in open court for probate by Mrs. Sallie Bateman executor therein named, and the due execution thereof by the said S. R. Bateman, deceased is duly proven by the oath and examination of A. J. Armstrong and Mark Majette, subscribing witnesses thereto; and it is further shown to the satisfaction of the Court by said witnesses that the said S. R. Bateman was at the time of making said Will of sound mind and memory, of full age to execute a Will and under no restraint to their knowledge, information or belief:

It is thereupon Considered, Adjudged and Decreed that said proof is sufficent and according to law, and that said paper writing is and contains the last Will and Testament of S. R. Bateman deceased. And on motion it is ordered that said Will be admitted to probate and recorded in the Book of Wills of Tyrrell County and as such filed as provided by law in the Office of the Clerk of the Superior Court of said County.

It is further Ordered that said Mrs. Sallie Bateman be allowed to qualify as executor as provided by law and enter upon the discharge of the duties imposed by said trust.
