In the name of God Amen: I Nathan Bateman Ser. Of the County of Tyrell and State of North Carolina being sick and weak of body but of sound mind and memory thanks be to God for the same calling to mind the mortality of my body and knowing that it is appointed for all men once to die, and as touching such worldly goods as it hath pleased God to bless me with I give and dispose of in the following manner and form.

I lend to my wife Mary Bateman during her life or widdowhood the use of my plantation with all the buildings thereon provided she does not marry or remove from it but if she does either it is no longer hers also one feather bed & furniture thereunto belonging weavers lomb all the harness wheels and all the cords one ax and one hoe one small pot & kettle three chairs one hand mill four plates one peuter dish & bason knives forks and teaspoons one tray one tub one pail one cow one sow & pigs four year old hogs the above gifts is during her life or widdowhood then to return to her three children Nancy Fanny & Penny, I give to my wife in order to support my children the crop and stock of all kinds. I give and bequeath to my two sons Hardy & Reading my land to be equally between them when they come of age and if either should die without heir for the land to decend to the surving one my will is that the dividing line run East & West & the one that hath the Southernmost part to have the privilege of a five feet ditch down the Westward part of the land. My will is that my just debts & funeral expences be paid out of the balance of my parishable estate and the residue thereof I give and bequeath to my daughter Ange to her and her heirs for ---

I nominate Daniel Bateman & James Wood my executors to this my last will & testament revoking all other wills by me made ratifying & establishing this my last will in witness whereof I set my hand and seal 2nd day of Decr. 1814. My will is for my exer. To bind my son Hardy to Abram Chesson & Reding to some good man of a house carpenters trade or wheel right and my daughter Ange to some good woman that will bring her up decently. I wish my son Reading to remain with my wife or so me good person until he is 16 years old and then to be bound the last nine lines is added before signed & acknoweded by the testor

in presence of us.

January Session 1815

The last will & testament of Nathan Bateman deceased was proved in court by the oath of Joseph Ansley Esqr. in due form of law.

Capn. Daniel Bateman came into open court & quallified to the last will & testament of Nathan Bateman deceased in due form of law.

Ordered that Nathan Spruill be appointed guardian protem to Henry {page torn} Penny Bateman orphans of {page torn} Bateman deceased.

April Session 1815

An inventory of the estate of Nathan Bateman deceased was returned in court by Capt. Danl. Bateman one of the executors of said deceased.

An account of sales of the estate of Nathan Bateman deceased was returned into court by Capt. Danl. Bateman executor of said deceased.

Ordered that Mary Bateman widow of Nathan Bateman deceased be allowed the sum of twenty one pounds for the support and maintenance of three orphan children one year to wit Henry Fanny and Penny Bateman to commence from the 1st day February last, and that the executor be directed to pay the same & that the former be ? for her years allowance.

October Session 1815

Joseph Wynn returned into court the years allowance and dower in land of Mary Bateman widow of Nathan Bateman deceased ordered filed.

January Session 1817

Ordered that Mary Bateman widdow of Nathan Bateman deceased be allowed thirty dollars for keeping her two children Penny & Fanny one year out of the estate of said deceased commencing 1st January 1816 as per account filed.

July Session 1817

Ordered that Richard Wood, Joseph Ansley and Benjamin Spruill Esqr. be appointed to audite and settle the estate of Nathan Bateman deceased and make return to next court.

October Session 1817

Ordered that Richard Wood, Joseph Ansley and Benjamin Spruill Esqr. be appointed to audite and settle the estate of Nathan Bateman deceased with his administrator and make returns to next court.

January Session 1818

Ordered that Richard Wood & Benjamin Spruill & Joseph Ansley be appointed to audite and settle the accounts of Daniel Bateman executor of Nathan Bateman deceased and that they make return to next court.

April Session 1818

Ordered that Benjn. Spruill Richd. Wood & Joseph Ansley Esqr. audite & settle the estate of Nathan Bateman deceased & make return to next term.

July Session 1818

The audited account of the estate of Nathan Bateman deceased was returned to court & filed.

Ordered that Mary Bateman widow of Nathan Bateman deceased be allowed thirty dollars for keeping two children Fanny & Penny one year - - and filed.

July Session 1819

Ordered that Marey Bateman widow of Nathan Bateman deceased be allowed sixty dollars for maintenance of Fanny & Penny Bateman two years as per account allowed & filed - - was for 1817 & 1818.

July Session 1821

Ordered that Mary Bateman be allowed sixty dollars for two years maintenance of Frances & Penelope Bateman orphans of Nathan Bateman deceased for 1820 & 1821 as er account allowed by the court & filed.

Summons dated 30 Dec 1822 and issued 10 Mar 1823 for Daniel Ansley to appear at next court to answer a plea of trespass by Daniel Bateman executor of the last will and testament of Nathan Bateman deceased. Five hundred dollars in damages claimed.

Public notice dated 12 Apr 1815 by Daniel Bateman that Nathan Bateman is dead and he qualified as executor of his last will & testament in the January term. All persons who have any claim or demand against the deceased must make it in the time permitted by law or be forever barred. Notice was posted at April term 1815 and taken down 20 May 1815.


Transcriber's Notes:
Tyrrell County marriage bonds show the marriage of Nathan Bateman to Frances Hatfield on 30 Jul 1800, John Bateman security.
It appears from the will and guardian records that Nathan Bateman was married twice, first to Frances Hatfield and second to Mary ? with whom he had Henry, Fanny & Penny. There are no apprentice records for the children he directed to be bound out in his will.
