October Session 1831

Ordered that Jacob Basnight be appointed administrator of the estate of Jos. Basnight deceased who entered into bond with Jos. Owens & Mathias Owens.

Ordered that Eph. Mann, Hez. G. Spruill & Gibeon Alexander lay off Dacas Basnight widow of Jos. Basnight her years allowance.

Jacob Basnight administrator of Jos. Basnight returns an account of sales of said Jos. Basnight & filed.

Ordered that Jacob Basnight be appointed guardian to Dacas Basnight widow of Jos. Basnight.

January Session 1832

Ordered by the court the order made at Oct Term court appointing Jacob Basnight guardian to Dorcas Basnight widow of Jos. Basnight be rescinded.

July Session 1833

Ordered Ephm. Mann, Hz. G. Spruill & Jno. Midgett audite and settle the estate of Jos. Basnight with his administrator.

January Session 1834

E. Mann returned into court the audited account of Jos. Basnight & filed - also on oath the account of sale of Wm. Pledger.

Bond dated 5 Sep 1831 in the amount of twelve hundred dollars appointing Jacob Basnight special administrator of the estate of Joseph Basnight Senr. deceased, Charles McCleese & Mathias Owens securities.

Bond dated 24 Oct 1831 in the amount of four thousand dollars appointing Jacob Basnight administrator of the estate of Joseph Basnight deceased, Jos. Owens & Mathias Owens securities.

Note dated 31 Dec 1831 promising to pay Jacob Basnight administrator of Joseph Basnight Senr. $137.50 after six months. Signed by John Tweedy, Jno. Edwards & Joseph Basnight and witnessed by E. Mann.

Petition January Term 1832 by Darkis Basnight widow of Joseph Basnight Senr. for dower in the lands of her deceased husband.

Petition January Term 1832 by Darkis Basnight widow of Joseph Basnight Senr. for laying off of her year's allowance out of the estate.

Notice to Torrence Cowel dated 29 Mar 1833 that his right of land in the estate of Joseph Basnight deceased has been levied by execution in favor of Benjamin Sikes. Signed by John Twidee.

Petition 7 Jan 1840 by Maxey Davis and wife Mary Ann late Basnight showing that Joseph Basnight died several years since leaving eleven distributees of his estate, of which Mary Ann who is now intermarried with petitioner Davis was one. Shortly after his death Jacob Basnight administered upon his estate and took into his possession a large amount of property valued at five thousand dollars or upward. Many years have now elapsed and petitioners are desirous of having their portion assigned to them by said administrator, which they have often called for to no effect. Petitioners pray that the administrator be summoned to court to answer the allegations hereof, set forth a true account of his administration and a decree be issued to give petitioners what is due them.

Summons dated the fourth Monday in April 1841 for Jacob Basnight administrator of Jos. Basnight to appear in court on the fourth Monday of July next to answer the petition of Maxey Davis and wife Mary A.

Answer of Jacob Basnight administrator of Joseph Basnight to the petition of Maxy B. Davis and wife Mary. Defendant states that he has always been willing to settle with the heirs at law but they never called upon him to do so. He further states that Joseph Basnight left as heirs at law or distributees Jonathan B. Twiddy, Elizabeth Twiddy & Caroline Twiddy who are not made parties to this petition. Very little if anything is coming to Maxy Davis.

Per audited account - $2514.74
Interest from 12 Nov 1833 to 28 Oct 1844 - $1635.13
Total - $4149.87
The whole amount is divided into 12 shares and that Max B. Davis and wife are entitled to the fourth part of one share, $86.45.


Transcriber's Notes:

With Maxey Davis and wife Mary Ann only entitled to one fourth of a share, it appears that Mary Ann is a granddaughter of Joseph Basnight Senr. Her maiden name has not been determined.
