In the name of God Amen. I Marilla Brickhouse of the county of Tyrrell and state of North Carolina being of sound mind and memory and calling to mind that it is appointed for all persons once to die. Do make and declare this to be my last will and testament in manner and form following. To wit: First, I desire that all my Just debts be paid to whom or howsoever owing. My desire is that all my personal property of whatever kind or nature be eaqually divided between my husband Thos. W. Brickhouse and my son William Franklin Brickhouse part and parcel alike and should my husband die without lawful issue of his own body then and in that case all of my personal estate shall be the property of my said son William Franklin Brickhouse to him and his heirs forever. I give and bequeath to my husband Thos. W Brickhouse during his life time only all that portion of my land on the westward side of the path or road leading through the field Beginning on the main road at eh foot of the new Brickhouse Road oposite J B Snell running northwardly up the land through the woods and through and along the path to the back line near the sound. Thence Westwardly to Jas. W. Spruill line thence southwardly along his line to the public road thence Eastwardly along the road to the first station containing fifty acres more or less. And at his death to be at once the property of my son William Franklin Brickhouse. I give and bequeath to my son William Franklin Brickhouse all of my real estate consisting of all the lands that I may own at the time of my death to him and his heirs forever subject only to the provision theretofore set forth, lastly I appoint my beloved husband T. W. Brickhouse executor to this my last will and testament to execute the same according to the true intent and meaning thereof. In witness whereof I have hereunto set my hand and seal and in the presence of the witnesses whose names are subscribed thereto declare the foregoing to be my last will and testament. Signed this the 11th day of September 1894.

In the superior Court.

A paper writing purporting to be the last will and testament of Marilla Brickhouse deceased. Is exhibited before me the undersigned clerk of the superior court for said county by T. W. Brickhouse executor therein mentioned. And the due execution thereof by the said Marilla Brickhouse is proved by the oath and examination of T. L. Jones and William Maitland the subscribing witnesses thereto. Who being duly sworn doth depose and say and each for himself deposeth and saith. That he is a subscribing witness to the paper writing now shown him purporting to be the last will and testament of Marilla Brickhouse. The said Marilla Brickhouse in the presence of these deponants subscribed her name at the end of said paper writing now shown as aforesaid and which bears date of the 11th day of September 1894. And the said deponents further saith the said Marilla Brickhouse, the testator aforesaid did at the time of subscribing her name as aforesaid declare the said paper writing so subscribed by her and exhibited by him to be her last will and testament. Aned these deponants did thereupon subscribe there names at the end of said will as attesting witnesses thereto. And at the request and in the presence of the said testator. And these deponants further saith at the said time when the said testator subscribed her name to the said last will as aforesaid and at the time of these deponants subscribing their names as subscribing attesting witnesses thereto as aforesaid. The said Marilla Brickhouse was of sound mind and memory of full age to execute a will, and was not under any restraint to the knowledge information or belief of these deponents: and further these deponants saith not.

It is therefore considered and adjudged by the court that the said paper writing and every part thereof is the last will and testament of Marilla Brickhouse deceased. And the same with the foregoing examination and this certificate are ordered to be recorded and filed. This 4th day of October 1902
