May 14th 1853

Concidering the uncertainty of this mortal life and being in sound and perfect mind and mimary, blessed be God for the same I make an ordan this my last will and testament I apoint Thomas Swain and Samuel A. Truett my executors I first of all give and bequeath to my beloved wife Nancy all of my land on the south side of the river road up to the Culipher line during her life time or widow hood ten head of her choice out of my stock of cattle also ten head of hogs her choice ten stocks of bees her choice eight head of sheap her choice and I also give to my beloved wife Nancy one negro girl by the name of Joicy and her increase during her life time or widow hood and then to be equally divided between James L. Brickhouse and Eliza Jane Brickhouse and I give my wife Nancy three beds ? ? of her choice one loom two wheels two trunks two chest one table one beaufat and crockery five chairs & I give to my beloved son James L. Brickhouse my land on the south side of the new road up to the Culipher line after the death or marriage of my wife I also give to my son James L. Brickhouse two guns and dutch fan (?) I thirdly give to my beloved daughter Eliza Jane Brickhouse all of my land on the north side of the main road along the swamp up to the lower ? Branch and then along the old patent line to the Culipher line I also give to my daughter Eliza Jane one trunk and three pots and one kettle and all the balance of my real and personal estate to be sold and equally divided between my children and Dorcas Brickhouse two children is to come in as heir and have eaqual shares with the other heirs

In witness where of I here unto have set my hand and affixt my seal this one thousand eighte hundred and fifty three

The foregoing paper writing was offered to the Court of Pleas & Quarter Sessions of Tyrrel County July Term 1853 by S. A. Truitt one of the executors therein for probate as the last will and testament of Simeon Brickhouse and probate thereof was refused by the Court
