Know ye to all people to whom These presents shall come Greeting that I Josiah Buffet of Huntington being in sound mind doth make and bequeath a certain piece of low land lying in Tyrrell County on ScupperLong River in the State of North Carolina unto his beloved son Jesse Weeks Buffet containg four hundred acres more or less, bounded at the beginning of Zebulon Terkintons landing runs about N.N.W. binding upon William and John Terkintons Godfrey Phelps John Phelps Senior and Samuel Casewell and as far as Nathan Bateman Junr. from thence through the swamp to the River and down the river to the first station. Ant the use of the said swamp I give unto my beloved wife Rachel as long as she remains my widow. As witness my hand and seal this the 16th day of April in the year of our Lord 1786. In presence of

Executors to this Will

James Swain John Phelps Senior and John Armstrong I likewise appoint and impower the said Executors to collect all my debts, dues either book bond or note in the County of Tyrrell and all other articles belonging to me whatsoever in said County likewise to take charge of the Sloop to see that she is repaired loaded and sent home with all dispatch convenient as witness my hand and seal this 16th day of April 1786. Tyrrell County October Term 1786

Personally appeared Henry Rhoades and made oath on the Holy Evangelist of almighty God that he saw and heard the within named Josiah Buffett sign, seal, publish, pronounce & declare the above instrument of writing to be his last will and testament, and at that time he was of sound mind and memory and at the same time he saw James B. Ketchum subscribing witness sign his name thereto & further saith not.

Tyrrell County Court of Pleas & Quarter Sessions


July Session 1786

Ordered that Henry Rhoades have leave of administration on the estate of Josiah Buffett deceased & gives in bond 1,000 pounds John Armistead & John Wynne securities & returns an inventory of the said deceased estate on oath - filed - {the following interlined} a will being produced in October term 1786 his administration set aside & grante to Jos. Tarkington.

Ordered that Henry Rhoades administrator of Josiah Buffett deceased sell the perishable part of the said deceased estate & make return to next court.

October Session 1786

The last will and testament of Josiah Buffett deceased exhibited by James Swain one of the executors identified in said will, neither of the executors qualifying administration was granted to Joseph Tarkington Senr. with the will annexed and proved by the oath of Henry Rhoades and ordered to be recorded.

Ordered that Joseph Tarkington Senr. have leave to administer on the estate of Josiah Buffett deceased with the will annexed and give bond in 1,000 pounds - John Swain son of Jerh. & William Flood securities filed - And that Joseph Tarkington administrator sell the perishable part of the said decased estate and make return to next court {followed by another sentence writen too small to read that mentions Henry Rhoades}.

July Session 1788

Hezekiah Spruill and Jeremiah Frasier Esqrs. appointed to audite and inspect the account of Joseph Tarkinton administrator of Josiah Buffett deceased and find a balance due the said deceased estate of 137 pounds & 10 pence ordered filed.

January Session 1792

Ordered that Samuel Chesson & Joseph Phelps Esqr. and Henry Norman or a majority of them be appointed to audite the accounts of Joseph Tarkinton administration of Josiah Buffett deceased & finally settle the same & make return to next court.

April Session 1792

Samuel Chesson Esqr. one of the auditors appointed to settle the accounts of Joseph Tarkintons administration of Josiah Buffett deceased exhibits their proceedings into court & there appears a balance in favor of said administrator of 15 pounds, 16 shillings & 11 pence account filed.
