Tyrrell County Court of Pleas & Quarter Sessions


October Session 1814

Polly Armstrong wife of William Armstrong deceased came into open court & relinquished her right of administration on said deceaseds estate in favour of Sylvinus Armstrong who entered into bond in the sum of two hundred and fifty pounds Rubin Cohoon & David Clayton securities.

Ordered that Sylvenus Armstrong administrator of the estate of Wm. Armstrong deceased sell the perishable estate of said deceased & make return to the next term.

Ordered that Thomas Liverman Timothy Jones & John A. Patrick lay off to Polly Armstrong widdow of William Armstrong deceased one years provision out of the estate of said deceased & make return to the next term.

January Session 1815

The years provision of Mary Armstrong was returned to court & filed.

Ordered that the widow of William Armstrong be allowed six pounds fifteen shillings in addition to an order allowed her during this term.

January Session 1816

Ordered that Mary Armstrong be allowed the sum of fifty dollars for the support of her two children out of her deceased husbands estate for one year.

July Session 1816

Ordered that Jno. A. Patrick Timothy Jones & Joseph White be apointed to audite and settle the estate of Wm. Armstrong deceased and make returns to next court.

October Session 1816

The audited account of William Armstrong was returned to court by Silvenus Armstrong his administrator & filed.

Ordered that James Hoskins Solomon Hassell & Jesse Alexander Esquires divide the estate of William Armstrong deceased with the legal representatives & make return to next term.

January Session 1817

Ordered that James Hoskins Solomon Hassell and Jesse Alexander divide the estate of William Armstrong deceased with the legal representatives & make return to next court.

Ordered that Polly Armstrong be allowed thirty dollars for keeping her two children one year out of the estate of her deceased husband William Armstrong.

April Session 1817

Ordered that Col. Jesse Alexander Thos C. Maddux & James Hoskins be appointed to divide the estate of William Armstrong deceased amongst his legal representatives and make returns to next court.

July Session 1817

Ordered that Jeremiah Wynne Charles Hoskins & John A. Patrick divide the estate of William Armstrong between the legal representatives & make return to the next term.

October Sesion 1817

The division of the estate of William Armstrong deceased was returned to court & filed.

Ordred that Jeremiah Wynne, Charles Hoskins & David Clayton be appointed to audite & settle the accounts of Sylvanus Armstrong administrator of William Armstrong deceased.

January Session 1819

Ordered that David Clayton Esqr. be appointed guardian to William & Russell Armstrong orphans of William Armstrong deceased & entered into bond of $500 dollars each Carny Spruill & Holoway Armstrong securities.

April Session 1819

Ordered that John A. Patrick Joseph White & William Alfred be appointed to audite & settle the estate of William Armstrong deceased with Selby Armstrong his administrator & settle with David Clayton guardian to the heirs of said deceased & make report to next term.

July Session 1819

Ordered that John A. Patrick Joseph White & William Alfred be appointed to audite & settle the estate of William Armstrong with his administrator & settle with David Clayton guardian to the heirs of said deceased & make report to next term.

October Session 1819

Report of auditors on the estate of William Armstrong deceased was returned to court ballance due the heirs $210.31 cts & filed.

Ordered that Thos. D. Weskett be allowed the sum of twenty five dollars for the maintenance of an orphan child of William Armstrong deceased to be paid out of the said Armstrongs estate.

January Session 1820

Ordered that Thomas D. Wesket be allowed the sum of twenty five dollars for the maintenance of William Armstrong orphan of William Armstrong deceased to be paid him out of the estate of said deceased.

April Session 1820

Ordered that David Clayton guardian to the heirs of William Armstrong deceased sell all the perishable estate belonging to the said heirs on a credit of six months taking ? with approved security at twenty days ? & make returns to next term.

October Session 1820

David Clayton returned in open court on oath an account sales of William Armstrong deceased amounting to ten dollars and eighty one cents and filed.

January Session 1821

Ordered that David Clayton guardian to the heirs of William Armstrong deceased be allowed the sum of seven dollars for expenses attending to the ? heirs estate as per account allowed by the court & filed.

April Session 1822

The following guardians appeared in open court & renewed their guardian bonds agreeable to the act of assembly in that case made & provided as follows viz. - -
David Clayton guardian to William Armstrong
David Clayton guardian to Russell Armstrong

January Session 1825

Ordered that Russell Armstrong orphan of William Armstrong be bound apprentice to Holloway Armstrong.

Ordered that Holloway Armstrong be appointed guardian to William Armstrong and Russell Armstrong orphans of Wm. Armstrong who entered into bond and gave as security Zebulon Tarkenton & Henry Gibson.

David Clayton came into open court and gave up the guardianship to Wm. & Russell Armstrong.

Ordered that David Clayton guardian of Russell Armstrong orpan of Wm. be allowed the sum of fifteen dollars for 3 months board and one quarter schooling said Russell in the year 1824.

January Session 1829

Holiway Armstrong appeared in open court & renewed his guardian bond to William & Russell Armstrong.

October Session 1830

Account of the rent of the land of Wm. & Russel Armstrong for the year 1830 was returned on oath in open court by Hol. Armstrong guardian.

Bond dated 10 Oct 1814 in the amount of two hundred and fifty pounds appointing Sylvenus Armstrong administrator of the estate of William Armstrong deceased, Ruben Cahoon & David Clayton securities.

Audit of the estate of William Armstrong deceased on 12 Oct 1816 as ordered by the court July term 1816 by Jno. A. Patrick & Joseph White. Account between Silvey Armstrong administrator and the estate shows $216.76 due the estate. Sales of the estate realized $366 and after costs, debts, etc. $216.76 remained.

Division of the estate of William Armstrong deceased on 8 Oct 1817 pursuant to court order of July term 1817 by Jeremiah Wynne, Ch. Hoskins & Jno. A. Patrick. Estate of $216.76 divided among lawful representatives as follows:
Mary Armstrongs part $72.25 1/3
William Armstrongs part $72.25 1/3
Russell Armstrongs part $72.25 1/3

Bond dated 12 Jan 1819 in the amount of five hundred pounds in which David Clayton is appointed guardian of Russell Armstrong orphan of William Armstrong deceased, Holloway Armstrong & Carney Spruill securities.

Summons dated 7 Mar 1820 for William Armstrong orphan of William Armstrong by his guardian David Clayton to appear before S. Walker or some other Justice of the Peace of Tyrrell County at the house of Jeremiah Wynne in Coumbia on 25 Mar 1820 to answer unto Thomas D. Weskett, Michael Walker plaintiffs in fact on a charge of ? under $30. Judgement was obtained for $25 and costs.

Bond dated 1 Apr 1822 in the amount of five hundred pounds in which David Clayton is appointed guardian of William Armstrong a minor orphan, Silvenus Armstrong & Danl. Bateman securities.

Bond dated 1 Apr 1822 in the amount of five hundred pounds in which David Clayton is appointed guardian of Russell Armstrong a minor orphan, Silvenus Armstrong & Danl. Bateman securities.

Bond dated 7 Jan 1825 in the amount of one thousand pounds in which Holloway Armstrong is appointed guardian of William & Russell Armstrong minor orphans, Zebulon Tarkenton & Henry Gibson securities.

Summons dated the 4th Monday in October 1828 and issued 25 Nov 1828 for Holloway Armstrong to appear in next court to renew his guardian bond for William and Russell Armstrong or the court will proceed to appoint another guardian.

Bond dated 26 Jan 1829 in the amount of one thousand pounds in which Holloway Armstrong is appointed guardian of William & Russell Armstrong minor orphans, Bennett Armstrong & Bennett Mann securities.

There are also a number of executions against the estate of William Armstrong for debt.

David Clayton's guardianship of the orphans of William Armstrong make it likely that Charlotte Armstrong was his sister.
