In the name of God Amen I Joseph Ansley planter of the county of Tyrrell and state of North Carolina of sound mind and memory thanks be to God for the same desiring to make this my last will and testament in writing first I recommend my soul to God that gave it and my body to the earth to be buried in a Christian like maner not douting but at the general resurrection my soul and body will be united together and forever injoy a blest immortality - And as touching such worldly goods as it hath pleased God to bless me with in this world I wish to dispose of the same in the following maner and form viz.

First I give and bequeath to Asa Noah Enoch and William Ansley suns of John Ansley all my land and swamp between Scupernong River and the plantation trat where I now live begining at the mouth of the Petatoe Knoad Run thence up the run to a black gum standing in the branch at Mary Batmans and Nathan Phelpses corner tree thence along the road and line to corner of the land I purchased of William Tarkinton thence along the line between the said land and Harmon Batmans land to Coln. Hodges line thence Hodges line to the river including all and singular the houses and plantations and all that pertain ther unto Allso all the catell on said plantation with their increas and the (?) - the negro man Jery first reserving unto John Ansley the free use and priveledge of the above mentione gifts or so much thereof as he may wish to retain during this life I hereby direct John Ansley at such time as he may think propper to devide of the above mentioned property between the above mentioned suns to them and their heirs forever -

I give and bequeath to John and Daniel Ansley my juniper swamp in (?) and that neither of them shall have priveledge to sell to aney other person to them and their heirs forever

I leave the use of my plantation to my loving wife Mary Ansley during life or widowhood with all the woodland belonging thereunto and building thereon Also nego wooman Abigail negro man Jack with the stock of every kind belonging to plantation except the young mare Susan and one cow and calf and two ewes and lambs with house and kitching furniture and the plantation tules.

I give to my daughter Amilia Smith one negro boy James during life and the young mare Susan the cow and calf and ewe and lambs excepted above and at her death to decend to her children lawfuly begoten of her body if aney or if she should die without lawfull ishue the above property to return to the heirs of her brothers equal.

I lend the use of the cleared and woodland that Daniel Ansley ocupies at this time being the southwest corner of the tract I now live on begining at a gum in the run west of the houses up the fence (?) line fence to the lane fence thence westerly the course of the lane to line called Davenports line to pine stump in fork of the run thence down the run to first station during his life and at his mothers death or marage should he survive her I lend the use of the other part of the plantation with all the woodland and building on said plantation except the one half of the wheat thrashing mechein to him during his life and at his death I give to his suns if aney living and if no suns to his daughters if aney the whole of tract with all that pertain therunto them and their heirs forever But should he die leaving no lawfull ishue of his body ariving to age of twenty one years then the whole of the plantation and woodland I give to surviving heirs of brothers and sisters to be eaquly devided between them and their heirs forever.

I give to my grandaughter Amely Ann Hassell one negro girl named Nancy allso one fether bed and furniture therunto belonging Also one cow & calf The above property to remain in the care of hir grandmother untill Amilla Ann arives to lawfull age if her grandmother dies before Amila Ann arives to lawfull age or maryes the property to be comited to the care of a guardeen appointed by the court to hire out the negroe and take caer of the other property untill her marage.

I give to John Ansley the other half of the wheat threshing mechein.

At my wifes death or marage the negroe girl Abigal and Jack to be sold and the money to be devided between Amila Smith and Unice Twedey or if either of them die without heirs her part to desend to the heirs of the (?) of the other brothers and sisters.

The remainer of my property not given away in legacys I leave to be sold and the money devided betwen John Ansley Daniel Ansley Amela Smith Unice Twedy and the heirs of Joanna Hassell.

I apoint David Clayton & Daniel Ansley (John Ansley crossed out) executors to this my last will and testament revoking all other former wills establishing this as my last will in testimony whereof I sete my hand and seal this the 8th day of June 1827.

The will of Joseph Ansly was exhibited in open court and proved by the oaths of Harmon Bateman & George W. Davenport subscribing witness thereto, who swore that he was of sound disposing mind and memory. At the same appeared Daniel Ansly one of the executors and qualified thereto.

October Session 1828

The will of Joseph Ansly was exhibited in open court and proved by the oath of Harmon Bateman & George W. Davenport subscribing witnesses thereto who swore that he was of sound & disposing mind and memory - at the same time appeared Daniel Ansly one of the executors and qualified thereto.

January Session 1829

Daniel Ansly executor of Jos. Ansly deeased returned an inventory & account of sales of the said estate.

Dempse S. Godfrey returned Mary Ansly's widow of Jos. Ansly years allowance & filed.

January Session 1831

Ordered that Zebulon Tarkenton, Daniel N. Bateman & Harmon Bateman audite and settle the estate of Joseph Ansly with Daniel Ansly his executor and report to next term.

April Session 1831

The audited account of Jos. Ansly was returned into court balance due estate of $41.80.

January Session 1833

Account of sale of the residue of the property of Jos. Ansley was returned in open court on oath by Danl. Ansley the executor.

April Serssion 1833

Daniel Ansly executor of Jos. Ansly returned into court on oath account sale of the negros of Jos. Ansly left to be sold.

Petition October Term 1828 by Mary Ansley, widow of Joseph Ansley deceased who states that her late husband died in September 1828 and his will appointed Daniel Ansley & David Clayton executors, but only Daniel Ansley qualified. She requests that commissioners be appointed to lay off her year's allowance out of the estate. Petition was granted and year's allowance was laid off on 27 Nov 1828.

Summons dated the fourth Monday in January 1829 and issued 11 Apr 1829 for Mary Ansley to appear at court on the fourth Monday of April next to answer unto Daniel Ansley & David Clayton in a plea of trespass to their damage of three hundred dollars.

Summons dated the fourth Monday in April 1829 and issued 11 July 1829 for Harmon Bateman, William A. Tarkenton & Jos. Halsey clerk of the county court to bring with him the will of Jos. Ansley & the record of the qualification of the executors & probate to testify on behalf of the plaintiffs in a case in which Daniel Ansley & David Clayton executors of Jos. Ansleyare plaintiffs and Mary Ansley is defendant.

Summons dated the fourth Monday in April 1829 and issued 13 July 1829 for William A. Tarkenton, John Hassell & Langly G. Pinner to testify in a case in which Joseph Ansley's executors are plaintiffs and Mary Ansley is defendant.

Summons dated the fourth Monday in July 1829 for Abner N. Vail to testify in a case in which Joseph Ansley's executors are plaintiffs and Mary Ansley is defendant.

Summons dated the fourth Monday in July 1829 for Wm. C. Mann to appear immediately and testify on behalf of Mary Ansley in a case in which Daniel Ansley executor of Jos. is plaintiff and Mary Ansley is defendant.

There are also documents relating to a suit by George W. Davenport against the estate in 1829.

Petition January Term 1831 by John Hassell and his wife Milly, Jonathan Twiddy and his wife Unice, Daniel Hassell, Amos Hassell & Amelia Hassell, by their guardian Enoch Hassell, Asa Ansley & Noah Ansley, Enoch Ansley & William Ansley, by their next friend, Enoch Hassell. They state that they are the distributees and heirs at law of Joseph Ansley who died after first making his will in which he appointed Daniel Ansley executor and who duly qualified as such and received the personal estate of Joseph Ansley in the amount of fifteen hundred dollasrs. Petitioners state that he has yet to account for the personal estate and request that a decree be issued for him to do so and pay such amount as is due to petitioners. Summons issued.
