In the name of God amen: I Joseph Ansley of Tyrell County and State of North Carolina being sick and weak of body but of perfect mind and memory thanks be given to Almighty God calling to mind the mortality of my body and knowing that it is appointed for all once to die do make and ordain this my last will and testament in manner and form following first and principally I recommend my soul into the hands of God that gave it and my body to the earth to be buried at the discretion of my executors hereafter mentioned and as touching such worldly estate as it hath pleased God to bestow on me in this life I give dimise and dispose in manner and form following. My will and desire is that all my just debts all be satisfied.

I lend the use of my manner plantation to my son Joseph Ansley untill Enoch Ansley son of Edward Ansley comes of age and then to be returned in good order for farming and if said Enoch Ansley personal appears when he arrives to lawful age in Tyrell County who is now living in Fines Co. I give and bequeath to sd. Enoch Ansley my manner plantation with all my woodland adjoining of said plantation except the Island Plantation provide said Enoch comes to this County of Tyrell to him and his heirs forever.

I give and bequeath to Joshua McKab the fourth part of my corn field with all the hogs and sheep that is called his and one yearling heifer one feather bed and furniture to him and his heirs forever.

I give and bequeath to my grandaughter Joanne Ansley daughter of Edward Ansley one negro girl named Hannah when she arrives to lawful age to him and heirs forever. My will is that said negro girl be hired out and the money arising for said hire be paid to Joanna Ansley when she comes of age by the executors heretofore mentioned. My will and desire is that my negro woman Abb and her increase from this date and negro boy Jack be sold at public sale when my grand son Enoch Ansley comes of age and that all the money arising from the sale of said negro be divided amongst my grand children heretofore mentioned that is Joanna Ansley daughter of Joseph Ansley, John Elizabeth Daniel Amelia and Wine Ansley to them and their heirs forever. My is that said negro be hired out until the time above mentioned and the money arising from said hire to be equally divided with the other money that ariseth from sale of said negroes.

I give and bequeath to my son Joseph Ansley all the residue and remaining part of my estate that is not hereafter given away which is the Island land Juniper swamp stock of every sort household kitchen furniture to him and his heirs forever.

I nominate constitute and appoint Joseph Ansley and Asa Phelps my whole and sole executors of this my last will and testament revoking all other wills by me heretofore made ratifying and confirming this only to be my last will and testament in testimony whereof I have hereunto set my hand and seal this first day of October 1800. October Session 1800

The last will and testament of Joseph Ansley deceased was proved in open court by the oath of Joseph Tarkinton one of the subscribing witnesses.

Capt. Asa Phelps and Joseph Ansley Junr. quallified as executors to the last will and testament of Joseph Ansley deceased.

October Session 1813

Joseph Ansley Esqr. executor to Joseph Ansley Senr. returned to court on oath the account of sales of negro woman Ab and five children amounting to $1151 dollars and ordered filed.

October Session 1814

Ordered that Joseph Ansley Esqr. be appointed guardian to Emilla Ansley & Unice Ansley & have entered into bond in the sum of one thousand pounds Jesse Spruill & Thos. Weatherly securities.

Petition in July Term 1814 of Enoch Hassell and wife Joanna and John Ansley who say that Joseph Ansley Senr. died in 1800 leaving a will appointing John Ansley Junr. and Asa Phelps as executors. Asa Phelps died soon after and Joseph Ansley Junr. took upon himself the sole burden of being executor. In his will Joseph Ansley Junr. specified that his negroes be hired out until Enoch Ansley came of age and then they be sold at public auction and the monies arising from the hire and the sale of the negroes are to be divided equally among his grand children, Joanna Ansley daughter of Joseph Ansley John Ansley Elizabeth Ansley Daniel Ansley Amelia Ansley and Unice Ansley. Your petitioner further shows that Elizabeth Ansley died after her grandfather without lawful issue and intestate. John Ansley is now of lawful age and Daniel Ansley is also of lawful age and Joanna has intermarried with your petitioner Enoch Hassell and the other legatees mentioned are under age and have no guardian appointed by the court, Joseph Ansley their father being their natural guardian. Petitioner further shows that Enoch Ansley arrived at lawful age about two years ago and the executor sold said negroes viz. Jack about 15 years old Abb about 40 years old Jim about 11 years old Jerry about 9 years old Tom about 4 years old Sarah about 4 years old and Jane about one year old, all the increase of Abb, at public sale in January 1812 and bought them all himself for 1,100 dollars whereas your petitioner charges they were worth 1,700 to 2,000 dollars. Your petitioner further states that Joseph Ansley hired out the negroes the first year after the death of his father and then kept them himself, getting the sole benefit of their labor. Petitioner asks that Joseph Ansley account for the hire and use of the negroes and be held to account for their true value.

Summons dated 11 Jul 1814 and issued 31 Jul 1814 for Joseph Ansley Esqr. executor of Joseph Ansley Senr. deceased to appear in court to answer a petition against him by Enoch Hassell & wife and others for the sale of negroes belonging to Joseph Ansley Senr. deceased.
