January 17, 1845


I, Abner Alexander of the state and county aforesaid do make this to be my last will & testament in manner following (viz) -

1st. I lend unto Samuel M. Alexander four negroes viz America, Oscar, Chloe & Jane during his life and at his death to be loaned to his children should he leave any in case the children left by him should die before arriving to the age of twenty one years or should die and leave no children after they arive to the age of twenty one years and leave no lawful issue then & in that case all the above named negros & their increase is to be equally divided between my brothers Jos. & T. H. Alexander

2nd. I lend unto my nephew Benjamin Spruill five hundred dollars to be paid to him by my exrs. when he may arive to the age of twenty one years without interest should said Benjamin die before he arives to the age of twenty one years or die without leaving any children after he arives to the age of twenty one years or should he leave children & they die before they arive to the age of twenty one years or should the said children leave no lawful issue then & in that case the above named five hundred dollars is to be equally divided between my brothers Jos. & T. H. Alexander

3rd. I lend unto my nephew Bushrod W. Alexander five hundred dollars to be paid to him by my exrs. when he arives to the age of twenty one years without interest should said Bushrod die before he arives to the age of twenty one years or die without leaving any children after he arives to the age of twenty one years or should he leave children & they die before they arive to twenty one years of age or should the said children leave no lawful issue then & in that case the above named five hundred dollars is to be equally divided between my brothers Jos. & T. H. Alexander

4th. I give unto my brothers Jos. & T. H. Alexander after my debts are paid all the remainder of my property of every kind to be equally divided between them Each here above mentioned are to pay of my debts in proportion to what are given or loaned to unto him I leave my brothers Jos. & T. H. Alexander Exrs. to this my last will & testament - Jany 17th 1845.

The foregoing paper writing was produced in open court at January Term 1845 and it appearing that the same is not in the hand writing of Abner Alexander and that there is but one subscribing witness thereto the court refuses to allow probate thereof -
