North Carolina, Richmond County - Court of Pleas and Quarter Sessions. October Term A.D. 1864. To the 
Worshipful the Justices of said Court. The petition of Isaac Mason, Executor of Isaac Mason, dec'd, 
against Nancy Hurly and Husband Samuel Hurly and Rachael Ingram and her Children, John Ingram and Joe 
Ingram, Winchester Mason, Rebecca Covington and Children, Isaac Covington, William Covington and Elizabeth 
Covington, Solomon Mason, Harriet Bigelow & Husband, John Bigelow. Your petitioner showeth:
1. That sometime in the year 1862 Isaac Mason died leaving a last will and testament and that he, Isaac 
Mason son of said Isaac Mason, deceased, and the above named defendants were the only legatees mentioned 
and described in last will.
2. That at October Term A.D. 1864 of said Court of Pleas and Quarter Sessions he was duly qualified as 
executor of said last will and testament of Isaac Mason.
3. Your petitioner further showeth that he has since justly executed said will and testament according 
to the requests therein made, so far as he has been able, by paying all his just debts and funeral expenses 
and his legacies so far as he could.
4. That he now has a small surplus and a few negroes in his hands which he is anxious and desirous of paying 
to the legatees.
5. That he has often applied to the said defendants and legatees to come to a full and fair account and 
settlement of the effects of his testator, with which request they have refused and doth still refuse to comply. 
To the end therefore that the said Nancy Hurly and Husband, Samuel Hurly, Rachael Ingram and Children, John 
Ingram and Joe Ingram, Winchester Mason, Rebecca Covington & children Isaac Covington, William Covington 
and Elizabeth Covington, Solomon Mason, Harriet Bigelow & husband John Bigelow may answer the premises and 
come to a full and fair account and settlement, and receive what may be ascertained to be due them, both 
general and special legacies. May it please your Worships to order subpoenas together with copies of this 
petition to be issued to Nancy Hurly  &  husband Samuel Hurly and Rachael Ingram and Joe Ingram to appear 
and answer and to order publications as to John Ingram, Winchester Mason, Rebecca Covington and children 
Isaac, William and Elizabeth, Solomon Mason, Harriet Bigelow and husband John Bigelow notifying them of 
the filing of this petition and directing them to appear and answer, etc. and your petitioner as in duty
