Last Will & Testament of Iris Holland




Iris Holland, long-time resident of Richmond County, will of 1997

I, Iris B. Holland, of Pitt County, North Carolina do make this Will and revoke all prior Wills and Codicils.

Statement of Family

As of the signing of this will, my family consists of my son, David Louis Holland, and my daughter, Diana Holland Faust. My granddaughter, Jana Elizabeth Holland Watkins, my grandsons, Roy Eugene Smith, Jr., and Louis Colbert Holland.

Article I

I direct my debts, my funeral expenses (including the cost of a suitable marker at my grave) and the cost of administration of my estate be paid out of the assets of my estate as soon as practicable after my death. I direct all legal debts, including death taxes, allowable as claims against my estate be paid out of the general funds of my estate and not charged against the beneficiaries.

Article II

I give any interest that I may have in my residence located at 2069 F, Quail Ridge Road, Greenville, North Carolina, to my son, David Louis Holland and my daughter-in-law Anna B. Holland.

Article III

I give all of my tangible property to my son, David Louis Holland, to be distributed among family members at his discretion.

I may attach a list of suggestions for disposition of certain items of personal property to this Will. I do not intend this list to be treated as part of this Will or as a Codicil to this Will. This list, that I may attach, is intended to be a guide for my Executor should he choose to use it.

Article IV

I direct that the balance of my estate be distributed as follows:

I give one-third of my estate to my daughter, Diana Holland Faust.

I give the balance of my estate to my son, David Louis Holland and my daughter-in-law, Anna B. Holland.

Article V

I appoint David Louis Holland, Executor of this Will. If David Louis Holland is unable to serve, I appoint my daughter-in-law, Anna B. Holland, as Executrix of this Will. I direct that my Executor shall serve without bond and give Executor authority to sell real estate or personal property without an order of court in the administration of my estate.

The term Executor in this Will shall include both make and female personal representatives.

I, Iris B. Holland, the Testatrix, sign my name to this instrument this 3 day of February, 1997, and being first duly sworn, do hereby declare to the undersigned authority that I sign and execute this instrument as my Last Will and that I sign it willingly, that I execute it as my free and voluntary act for the purposes therein expressed, and that I am eighteen years of age or older, of sound mind, and under no constraint or undue influence.

We, Lawrence S. Graham and Donna D. Tripp, the witnesses, sign our names to this instrument, beign first duly sworn, and do hereby declare to the undersigned authority that the Testatrix signs and executes this instrument as her Last Will and that she signs it willingly, and that each of us, in the presence and hearing of the Testatrix, hereby signs this Will as witness to the Testatrix's signing, and that to the best of our knowledge the Testatrix is eighteen years of age or older, of sound mind, and under no constraint or undue influence.
