Jno. Norris & Wife to Wm UmFleet - 28 May 1728

Bill Umphlett obtained information about a land sale from a book "Tales from Old Carolina" by F. Roy Johnson, published by Johnson Publishing Co, Murfreesboro, N.C.  in 1965. On page 109 the following is stated. "The name
"Scratch Hall" was well established in the eighteenth century. On June 4, 1728, three months after the Virginia-Carolina dividing line survey made it known the area lay in North Carolina, John Nairn and his wife Mary sold 200
acres "on West Side of Scratch Hall Pocosin" to William Umfleet (Umphlett) of Nansemond County, Virginia. Abstract of conveyance original in Court House at Edenton, N.C. *Gates County formed in 1779 from Chowan and
Hertford Counties.  In addition, "The Lost Tribes of North Carolina by Worth S. Ray, Pub. 1947 Index to Vols. 1-2-3 of the NC Historical & Genealogical Register Vol. 2 page 443. William Umfleet (Umphlett) of Nansemond County, Virginia, bought lands in Chowan Co. North Carolina from John Norris in 1728 on June 4th , 200 acres on West side of Scratch Hall Pocosin. Abstract of conveyance original in Court House at Edenton, N.C. Note: Gates County formed in 1779 from Chowan & Hertford Cos.

    THIS DEED made this 29th day of June 1903 by Charney Umphlett & wife Martha Umphlett of Perquimans County and State of N.C. of the first part to W.F. Umphlett of Perquimans County and State of N.C. of the second part, WITNESSETH: That said Charney & Martha Umphlett in consideration of Eight Hundred & Thirty Six Dollars, to be paid by W.F. Umphlett, the receipt of which is hereby acknowledged, has bargained and sold, and by these presents does bargain, sell and convey to said W.F Umphlett and his heirs and assigns, a certain tract or parcel of land in New Hope Township Perquimans County, State of N.C. adjoining the lands of Mrs. M.A. Scott and others, bounded as follows, viz: Beginning at a certain ditch at the M.A. Scott line and running N.57.E10, ch.
To a ditch, a 38.E.10, ¾ ch.N.13.E44, ¾ to the Coake lane, thence down said lane N.69.W.16ch & 23 l’ks. To a marked gum, thence S.19W.42ch to main road, thence 8.45.E.11ch, thence 37 W 16 ch.75 l’ks to ditch, thence S. 43. E.1 1/4 ch. N 87, E. 4ch. to first station, containing 92 8/10 acres & being same as surveyed by T.A. Morgan, May 6,1903 & plat herewith attached.
    TO HAVE AND TO HOLD the aforesaid tract or parcel of land and all privileges and appurtenances thereto belonging, to the said W.F. Umphlett his heirs and assigns to his only use and behoof forever, AND THE SAID Charney & Martha Umphlett does covenant to and with the said W.F. Umphlett his heirs and assigns forever, and that they are seized of said premises in fee, and
has a right to convey the same in fee-simple; that same are free from all encumbrances, and that they will warrant and defend the said title to the same against the claims of all persons whatsoever,

Umphlet and his heirs an assigns, a certain tract or parcel of land in New Hope township, Perquimans County, State of North Carolina adjoining the lands of J.A. Russell & J. H. T. B. Walters to Maggie Walters Deed - 28 April 1908

     By virtue of a Mortgage made to me by Nathan Tucker and wife, which said Mortgage is duly recorded in M.D. Book 7, Page 60, register of Deeds office of Perquimans County, N.C. the said Tucker having failed to comply with the terms & requirements of said Mortgage, I did on Monday April 27th 1908, at 12 o’clock Noon, after due advertisement as required by said Mortgage, offer for sale to the highest bidder for cash, at the Court House door in Perquimans County, all the land described in said Mortgage (except 5a. sold by said Tucker to E.W. Turpin by deed recorded in Deed Book 7, #573, Register of Deeds office Perquimans County, N.C.) when and where appeared among others Maggie A. Walters, by her Attorney W.S. Blanchard and bid the sum of forty three hundred dollars, which was the highest and best bid and the Said Maggie A. Walters was declared to be the purchaser at said price.
     Now therefore This Deed Made this 28th day of April 1908 by T.B. Walters, Mortgagee, of the first part, and Maggie A. Walters of the second part, all of the County of Perquimans and state of North Carolina, Witnesseth, That for and in consideration of the premises and the payment of the said sum of Forty three hundred dollars, the receipt of which is acknowledged, the said T.B. Walters, Mortgagee, has bargained and sold and by these presents does alien and covey to the said Maggie A. Walters and her heirs and assigns all that certain tract or parcel of land situated in Bethel Township, Perquimans County, N.C. adjoining the lands of T.B. Walters, M.H. White & others & described as follows:
     Beginning at a ditch on the New road leading through “Gilliam Farm” and running N. 59E. 35 chs. To River, then Various courses of River shore 19-1/2 chs. to run of branch the Granberry line, thence various courses of branch to E.W. Turpin line thence the courses of Turpin line to said road, then along the road N.26 W. to the beginning, containing 109-7/10 acres, And being all the land conveyed in said Mortgage except 5a, sold by Tucker to E.W. Turpin as described in Deed recorded in Book 7, 573, Register of deeds office Perquimans County, N.C.
     To Have & To Hold said land together with all her privileges and appurtenances the hereunto in any wise appertaining to her the said Maggie A. Walters her heirs & assigns forever.      This Deed, made this 24th day of February 1911 by T. B. Walters and wife Maggie Walters of Perquimans County and State of North Carolina, to W.F. Umphlett of Perquimans County and State. Witnesseth, that said T.B. Walters and Maggie Walters his wife, inconsideration of One hundred Forty Dollars, to them paid by the said W. F. Umphlett, the receipt of which is hereby acknowledged have bargained and sold, and by these presents, do bargain, sell and convey to said W. F. Umphlett and his heirs, a certain tract of land in said County and State bounded as follows: Being Lots #22 and #23 on plot of property known as Hertford Heights situated near Hertford as surveyed and plotted by Reish and Snodgrass, which said plat or map is recorded in book 2 pages 2&3, Registered of Deeds office, Perquimans County.
     That the premises shall not be occupied by Negroes or persons of mixed Negro blood, provided that this shall not be construed upon the living upon the premises of any Negro servant whose time is employed for domestic purposes by the occupants of the dwelling house.
     TO HAVE AND TO HOLD the aforesaid tract of land and all privileges and appurtenances there to belonging to the said W.F. Umphlett and his heirs, and assigns, covenant that they are seized of said premises in fee, and have the right to convey the same in fee simple, that the same is free from all incumbrances, and that they will warrant and defend the said title to the same against the claims of all persons whatsoever.

Umphlet in consideration of One Hundred & Twenty Dollars, to ______paid by________, the receipt of which is hereby acknowledged, have bargained and sold, and by these presents do bargain, sell and convey to said T.B. Walters and his heirs and assigns, a certain tract or parcel of land in ___________Township, Perquimans County, State of North Carolina, adjoining the lands of _______Being lots #22 & #23 on plat of property known as Hertford Heights situated near Hertford platted and surveyed by Reish & Snodgrass which said plot or map is recorded in Book 2 pages 2&3, Registered of Deeds office Perquimans County.

    Char. Whedbee, Trustee in certain Deed of Trust made by J.J. Fleetwood & wife to Chas. Whedbee Trustee to secure Thos. Nixon the sum of $30,000. duly recorded in M.D. Book 9, Page 542, register of Deeds office, Perquimans Co. executes this deed at direction of Thos. Nixon for the purpose of releasing the land herein conveyed from said Trust & for no other purpose.
    TO HAVE AND TO HOLD the aforesaid tract or parcel of land and all privileges and appurtenances thereto belonging, to the said T.B. Walters & his heirs and assigns, to their only use and behoof forever. And the said J.J. Fleetwood covenant to land with the said T.B. Walters heirs and assigns, that he seized of said premises in fee, and has right to convey the same in fee simple; that same are free from all incumbrances, and that he will warrant and defend the said title to the same against the claims of all persons whatsoever.

    THIS INDENTURE, Made on the 23rd day of Dec. 1918, between T.B. Walters, Mortgagee, of the County of Perquimans and State of North Carolina of the first part, and Maggie A. Walters
of the same County and State, of the second part: WITNESSETH, That whereas, by a certain mortgage deed made by Rosa A. Green & husband to said T.B. Walters, Mortgagee on the 25 day of Nov. 1912, to secure the payment of a debt of ____________Dollars, an interest due to said T.B. Walters, Mortgagee, as will fully appear on reference being had to said deed (see Register’s Office of Perquimans County, Book 10, page 159), the condition of  which not being complied with the said T.B. Walters, Mortgagee did, according to said conditions, expose to public sale the property therein mentioned, and thereby conveyed, that is to say, the tract of land described in said mortgage; and the said Maggie A. Walters being the last and highest bidder at the price of Five Hundred Dollars, became the lawful purchaser.
     NOW, THEREFORE, This indenture witnesseth, that the said T.B. Walters, Mortgagee for and in consideration of the said sum of Five Hundred Dollars, to him in hand paid by the said Maggie A. Walters the receipt whereof is hereby acknowledged, hath given, granted, bargained and sold, and by these presents doth give, grant, bargain and sell unto the said Maggie A. Walters all the aforesaid tract or parcel of land lying and being in the said County of Perquimans, State of North Carolina, and described as follows: A tract of land in New Hope Township, beginning on the road at an Iron Post at Hinton’s corner, and running N. 50 E. 18-36/100 chs, to a line, then S 40#. 9 38/100 chs. To a ditch, then S. 50 W. along the ditch and a line of marked trees to the road, then along the road N. 40 W. 9-38/100 chs. To the beginning, containing Seventeen (17) acres, be the same more or less together with all appurtenances thereunto belonging.
     TO HAVE AND TO HOLD to them, the said Maggie A. Walters in fee simple forever.  And all the estate, right, title and interest thereby conveyed, the said T.B. Walters doth covenant to warrant and defend so far as he has power and lawful authority to convey, and assure the same by virtue of his office or duty as mortgagee, and no further.

Walters in consideration of Forty-Six Hundred Dollars to them paid by W.F. Umphlett, the receipt of which is hereby acknowledged, have bargained and sold, and by these presents do bargain, sell and convey to said W.F. Umphlett, and his heirs and assigns, a certain tract or parcel of land in Hertford, Hertford Township, Perquimans County, State of North Carolina, adjoining the lands of E.D. Winslow and others, bounded as follows, viz: Beginning at the intersection of Church & Grubb Streets in Hertford, N.C. and running along Grubb Street to the property of Perquimans County, thence southerly to the line of E.D. Winslow’s lot, thence westerly along Winslow’s line to Church Street, thence northerly along Church street to beginning.  Also one-half of Brick Wall of the E.D. Winslow’s store.  Being the same property and rights and privileges conveyed to T. B. Walters by J.J. Fleetwood & wife, by deed duly recorded in Deed Book 12, page 388. Also see deed from N.A.     Whereas, under and by virtue of a mortgage deed executed to T.B. Walters by K.B. Coffield, which bears date of December 1st 1919, and registered in Book 13, page, 3 Register of Deeds for Perquimans County, default having been made in the payment of the purchase price of the said mortgaged land, and after due advertisement as required by law, the land was sold to the highest bidder at the Court House door in Hertford, Perquimans County, North Carolina, on the 7th day of January 1922, where and when appeared Maggie A. Walters who was declared to be the last and highest bidder, who after the lapse of the statutory period was still the highest bidder an having satisfied the terms of the sale.
    Therefore, this Indenture made this the 4th day of February 1922, by and between T.B. Walters, Mortgagee, party of the first part, and Maggie A. Walters, party of the second part, WITNESSETH, That for and in consideration of the premises and the sum of four hundred dollars in hand paid to the party of the first part receipt of which is hereby acknowledged, the said T.B. Walters, Mortgagee has  bargained and sold and by these presents doth alien and convey unto the said Maggie A. Walters, her heirs and assigns the following described tract of land, lying
and being in Bethel Township, Perquimans County, and bounded on the North by the Perquimans River Swamp, on the South by the said K.B. Coffield land and others, on the East by Mrs. M.H. White’s land, West by land of T. B. Walters, containing 9 acres more or less, and being the same land conveyed to K.B. Coffield by T. B. Walters.
    TO HAVE AND TO HOLD unto Maggie A. Walters, her heirs and assigns, the above described tract of land in fee simple forever, in as full and ample manner as the said mortgagee is empowered to convey the same.

Martha Umphlett to D.C. Umphlett et al. - 10 June 1926

Whereas Charney Umphlett, late of the County of Perquimans, State of North Carolina, died intestate, leaving surviving him, several children, hereinafter named and a widow, Martha Umphlett and Whereas, the said Charney Umphlett was possessed of goods and lands of which the said Martha Umphlett is entitled to dower, and Whereas, the said Charney Umphlett having expressed his wish as to the extent of the dower of the said Martha Umphlett, and she being advised of her rights, and of the wishes of her husband, has bargained with the several children, the now heirs at law, to receive a certain sum of money, namely, three thousand dollars, in lieu and place of all right of dower which the said Martha Umphlett might be entitled to receive the lands of the said Charney Umphlett of any right or interest which she has or might have, is the purpose of this instrument.
    This indenture made this the 8th day of June 1926 by and between Martha Umphlett, party of the first part and Lethia Jackson, D.C. Umphlett, Mattie Dail, Blanche Nurney, Celia Boyce, Leonard Umphlett, Moulton Umphlett, parties of the second part.
    That for and in consideration of the premises and in consideration of the sum of three thousand dollars, in hand received from the parties of the first part, receipt of which is acknowledged, the said Martha Umphlett hath released, confirmed and quitclaimed, unto the parties of the second part, and by these presents doth release confirm and quitclaim unto the said parties of the second part, their heirs and assigns, all her right, title and interest and property in and to the said tracts of land described as follows:
     First: A certain tract of land in Perquimans County in New Hope Township, adjoining the lands of George Eure, T.E. Winslow, R.C. Jenkins, now owned by J. Haskett, Alethia Hoskins, now owned by Charlie Banks, containing seven hundred acres, it being that part of the Jas. P. Whedbee estate on which the residence stood and which was purchased by Pattie Coke of B.S. Skinners executors, excepting however, the part formerly sold to Charney Umphlett by deed recorded in Deed Book “RR” page 520, and it being the same land deeded to Charney Umphlett by M.L. Eure, trustee, which conveyance is recorded in Deed Book “WW”, page 374, Register of Deeds office for Perquimans County save that part which has been deeded to W.F. Umphlett. And it being all the tract of land owned by Charney Umphlett at his death which was known as the Coke farm.
     Second: That tract of land beginning on Cove road at Alfred Umphlett’s corner, at the head of a branch, and running along said Umphlett’s line to the edge of the swamp, thence along the edge of the swamp to a marked gum; thence North 35 degrees East, sixty links to Robert Spivey’s corner, thence along the said Spivey line South 78 W. 22-81/100 chains to the road, and along the road N. 19W. ten chains to the place of beginning, containing 24-4/10 acres. And being the same land deeded to Charney Umphlett by J.L. Turner and wife Annie Turner which conveyance is registered in Deed Book #7, page 5712, Register of Deeds office for Perquimans County.
     TO HAVE AND TO HOLD unto the said parties of the second part, their heirs and assigns, all interest right or title which the said Martha Umphlett has or may be entitled to in the above described tracts of land, forever.

     WHEREAS, the undersigned trustee, under and by virtue of the authority of a certain Deed of Trust recorded in Book #15 page 210 Register of Deeds Office for Perquimans County, did advertise and sell the land hereinafter described at the Court House Door in Hertford, after having advertised the same as by law provided, and by the terms of said Deed of Trust, on the 10th day of March, 1930, where and when Mrs. Maggie A. Walters became the last and highestbidder in the sum of $250.00, and more than ten days having elapsed, and the said bid not having been raised, and the purchaser complying with the terms of the bid and desiring a deed
     NOW THEREFORE, this deed made this the 21st day of March, 1930, by and between L.E. Griffin, Trustee, party of the first part and Mrs. Maggie A. Walters, party of the second part, WITNESSETH;
     THAT for and in consideration of the premises and the sum of Two Hundred and Fifty Dollars in hand received paid by the said second party, and under and by virtue of the power conferred by the above named Deed of Trust, the said Griffin, Trustee, has bargained and sold and by these presents doth alien and convey unto the said Mrs. Maggie A. Walters her heirs and assigns, the following described real estate, lying and being in New Hope
Township, Perquimans County, North Carolina, as follows:
      Beginning on the Swamp Road near the corner of the fence of the old Jim White place, thence South 28 W. 21 ¾ chains; thence South 73 W. 31 ½ chains; thence N 34 E 50 1/3 chains to Swamp Road, thence along the road to the place of beginning, containing 80 acres more or less, being a part of the Joe Newby land.
     TO HAVE AND TO HOLD unto the said Mrs. Maggie A. Walters, her heirs and assigns, the above described tract of land, with all appurtenances thereto belonging, forever, in as full and ample manner as the said L.E. Griffin, Trustee, is authorized and empowered to convey the same.

    WHEREAS, Leonard Umphlet, of Perquimans County, North Carolina, is justly indebted to Madge Hedrick, of Chowan County, North Carolina, in the sum of One Thousand Three Hundred Thirty Four Dollars, due by bond on this date, bearing interest from date till paid, the interest papyable annually at the rate of 6 per cent per annum, and payable on or before the 1st day of January 1938; and to secure the payment of the said bond, with all
interest and costs, is the object and purpose of this deed.
    NOW, THEREFORE, THIS INDENTURE, Made this 12th day of April, 1937, by the said Leonard Umphlett and his wife, Margaret Umphlett of the first part, to Evvie Umphlett, of Chowan County, North Carolina, Trustee of the second part:
WITNESSETH, That the said parties of the first part, for and in consideration of the premises and of one dollar to them paid by the said Evvie Umphlett, Trustee the receipt of which is hereby acknowledged, have given, granted, bargained and sold, and do hereby give, grant, bargain, sell and convey unto the said Evvie Umphlett, Trustee, and unto her heirs and assigns, forever, 2 certain tracts of land in New Hope Township, Perquimans
County, North Carolina, and bounded and described as follows:
     FIRST TRACT; That certain tract containing 100 acres, more or less, known as the W.F. Umphlett Home Place, formerly known as the Jackson Place, and being the lands purchased by W.F. Umphlett, deceased from said Jackson.
     SECOND TRACT;  That certain tract known as the Store Tract, containing 15 acres, more or less, adjoining the lands of Joe Harrell on the East, J.W. Overton on the North and on the West by the Hertford-Durants Neck Highway.
TO HAVE AND TO HOLD the said tracts of land, with all rights, privileges and appurtenances thereto belonging, to her the said Evvie Umphlett, Trustee, his heirs and assigns, absolutely and in fee simple. The said parties of the first part covenant that they lawfully seized of said premises; that they have good right to convey the same free of all encumbrances, and that they  will warrant and defend the title herein conveyed to the said Evvie Umphlett, Trustee, his heirs and assigns, against the claims of all persons whomsoever.
    BUT IN SPECIAL TRUST for the following purposes: If the said Leonard Umphlett his heirs, representatives or assigns, shall pay the interest annually on said bond as it may accrue,and shall pay the principal in full at maturity, and all costs that may hereby accrue, then this deed shall be null and void and canceled. But if they fail either to pay the interest annually or lthe principal full at maturity, then in default of either, and at any time thereafter, the said Evvie Umphlett, Trustee, at the instance of the said Madge Hedrick, the beneficiary in this deed, or his assigns, shall sell the said tracts of land, after due advertisement, by public action, for cash, at the courthouse door in Hertford, North Carolina, and out of the proceeds of such sale, after reserving five percent thereof for his costs and trouble, he shall pay and discharge the said bond and all costs hereby accruing, and the balance, if any, he shall pay to the said dpart of the first part, heirs or assigns.
