359.  26 Feb. 1802; May Ct. 1802.  Decision in controversy respecting will of COL. PHILEMON HAWKINS, Sr. , dec'd. ,  by arbitrators chosen by Col. JNO. HAWKINS & Col. PHIL HAWKINS on behalf of himself & his brother BENJAMIN HAWKINS.  Unanimous decision  (by JAMES TURNER,  JOHN MACLIN,  JOHN WORTHAM,  GREEN DUKE,  WILLIAM PERSON & WILLIAM E. JOHNSON) that the will,  made 22 July 1801,  & Codicil of same date,  both witnessed by JAMES VAUGHAN & WILLIAM GILLIAM,  both of Granville Co. ,  was the voluntary act of deed. & that the will should be admitted to record.  Certificate from J. FAULCON that he concurs in the above opinion,  he having been chosen by above referees to act as an umpire in case of a disagreement & that he is giving his opinion at their particular request,  though unnecessary since their decision was unanimous.
