MORTAGAGE DEED - With Insurance Clause

NORTH CAROLINA, Catawba County.

THIS INDENTURE, Made this 8th day of September, A.D. 1928, by and between Mack Williams and Pearle Williams, his wife, of Catawba County and State of North Carolina parties of the first part, and Mrs. Ella Harrelson (widow) J.W. Harrelson and Elizabeth Harrelson (single) of Catawba County and State of North Carolina parties of the second part:

WITNESSETH, That whereas, said parties of the first part are justly indebted to said parties of the second part in the sum of Nine Hundred Dollars, as evidence by a bond of even date herewith, bearing interest from date at 6 per cent per annum, and due and payable on the Four Hundred Fifty & no/100 payable September 8th 1929, & Interest and Four Hundred Fifty & no/100 payable September 8th 1930 & bal. Interest (the rest unreadable).

AND WHEREAS said parties of the first part are anxious to secure payment of said bond at maturity: Now, therefore, in consideration of the premises, and for the purposes aforesaid, and for the sum of ten dollats to the parties of the first part paid by the parties of the second part, the receipt of which is hereby acknowledged, said parties of the first part have given, granted, bargained, sold, aliened, conveyed and confirmed, and by these presents do hereby give, grant, bargain, sell, alien, convey and confirm unto said parties, of the second part, their heirs and assigns forever, a certain piece or tract of land lying and being in Newton Township, Catawba County, State of North Carolina, and described and defined as follows to wit:

Fronting on N.E. Side of Sixth Street in the City of Maiden, N.C. and being Lots No. 10 & No. 11 as shown by referance to the Plot and Survey made of the J.H. Harrelson Estate Aug. 20, 1928 by D.R.S. Frazier, C.E., which is of record Office Register Deeds, Catawba County, N.C.

Lot No. 10 has a frontage of 64.2 feet on Sixth Street and a depth of 75 feet running N. 66 o 90' to Lot No. 7 Residence Lot bought by George W. Heavner and there is situated a small residence upon the same.

Lot No.11, has a frontage of 50 feet on N.E. Side of Sixth Street and a depth of 160 feet and a vacant lot.

Mrs. Ellen Harrelson is the widow of J.H. Harrelson deceased and J.W. Harrelson is a son and Elizabeth Harrelson is only daughter of J.H. Harrelson desceased.

The original of the istrument, together with the notes secured thereby, having this day been exhibited to the undersigned marked "FULLY PAID AND SATISFIED" by the grantee, I herewith cancel the same of record, under and by virtue of authority contained in paragraph 2, Section 2594 of the Consolidated Statutes of North Carolina.

TO HAVE AND TO HOLD said land and premises to_____, said parties of the second part, their heirs and assigns forever. And said parties of the first part do convenants to and with said parties of the second part, their heirs and assigns: That they are the owners and seized of said premises in fee simple; that they have the right to convey the same; that the same are free from any incumbrance whatsoever, and that they will forever warrant and defend the title to the same from the lawful claims of all persons whomsoever.

IT IS UNDERSTOOD AND AGREED between the parties to this Deed, that the parties of the first part shall keep the buildings on premises insured in some reliable Insurance Company having an agency in the said County of Catawba, in the sum of __________________ Dollars, and if any loss should occur the same shall be payable to the parties of the second part, to be applied as far as it may extend to the satisfaction of this Mortgage. And if the parties of the first part shall fail to insure said buildings for ten hours, the parties of the second part shall be at liberty to effect such insurance, and the amount expended for insurance shall be deemed principal money bearing 6 per cent interest per annum, and be secured by the lien of this indenture, and be payble when the next installment of interest becomes due.

But this Deed is made on this special trust: That if said parties of the first part shall well and truly pay or cause to be paid to said parties of the second part, or their legal representatives, the bonds hereinbefore described, at maturity, then this Deed to be null and void.

But if default shall be made in the payment of said bonds, or the interest on the same, or any part of either, at maturity, then and in that event it shall be lawful for said parties of the second part to sell said land hereinbefore described to the highest bidder, for cash, at the courthouse door in Catawba County, after first advertising said sale by posting notices thereof at the courthouse door and three other public places in said county for thirty days immediately preceeding sale, and also publishing said notice for four weeks in some newspaper published in said county, and convey the same to the purchaser in fee simple; and out of moneys arising from said sale to pay said bonds and interest on same, together with costs of sale, and pay surplus (if any) to said parties of the first part, or their legal representatives.

IN TESTIMONY WHEREOF, said parties of the first part hereto subscribe their names and affix their several seals.

I, R.A. Rudisill, J.P., do hereby certify that Mack Williams and Pearle Williams his wife, personally appeared before me this day and acknowledged the due execution of the annexed Mortgage Deed; and the said Pearle Williams being by me privately examined, separate and apart from her husband, touching her voluntary execution of the same, doth state that she signed the same freely and voluntarily, without fear or compulsion of her said husband or any other person and that she doth still voluntarily assent thereto.
