In the name of God Amen . I Margaret WEBSTER of the County of Hyde and State of North Carolina being of sound and desposing mind and memory thanks be to God for the same and calling to mind the mortality of my life and knowing that it is appointed for all men one to die and is _____my worldly estate that it hath been please God to Bless me with. I give and dispose of in the following manner.
- First I give and bequeath unto my son Benjamin SPENCER my land and plantation on the south side of Far Creek that was left me by the will of my son John SPENCER being ____acres more or less lying between Martin CREDLE & wifes land and the land of Benj. GIBBS land I also give to my son Benjamin SPENCER one negro man named STEPHEN? and a negro woman named PRUDENCE and his children where I also give to my son Benjamin SPENCER one feather bed and furniture and the residue of the personal estate of Jones SPENCER, dec'd ., that was set off on belonging to my son John SPENCER that he heired from the said Jones SPENCER estate to him and his heirs forever.
- Second I give and bequeath unto my son Samuel SPENCER toe negros the names of CHARLES and ELI, one fether bed and furniture to him and his heirs forever.
- Thirdly I give and bequeath to my grand son John MARSHALL all the land & plantation that formerly belonged to my son John SPENCER at Wysokon and all the lands of Thomas SPENCER, ESQ., dec'd., on the following conditions, if said John MARSHALL die without lawful issue then the said land to belong? to his Half brother Samuel DAVIS and I further give to my grandson John MARSHALL the one Half of a negro woman named MARY to go in the same land if he die with issue.
- Fourthly I give and bequeath to my grand daughter Margaret DAVIS two negroes named RACHEL and DAVID, one set of silver table spoons & one set silver tea spoons, the following condition (viz) if the said Margaret DAVIS die with lawful issue the whole of her legacy to go to John MARSHALL and Samuel DAVIS equally.
- Fifthly I give and bequeath unto my grand son Samuel DAVIS the other half of negro woman named MARY on the following conditions, (viz) if he die with lawful ______ ____to his half said negro MARY to John MARSHALL.
- Sixthly all the ___ and ____ of my estate not already given away or otherwise disposed of in this I give and bequeath to my two sons Benjamin SPENCER & Samuel SPENCER equally to be divided to them and their heirs forever.
I nominate and appoint my two sons Benjamin SPENCER and Samuel SPENCER my whole ____executors to this my last will and Testament revoking all other will & wills made and satisfying this and no other. In witness whereof I the said Margaret ____ have hereunto set my hand & seal this eleventh day of June 1824.
