Dorcas Swindell

In the name of God, Amen.

I Dorcas Swindell of the County of Hyde and State of North Carolina being of sound mind and memory but considering the uncertainty of life do make ordain and declare this to be my Last Will and Testament in manner and form following --

Imprimis - My will and desire is that after my decease my Executor hereinafter named shall provide for my body a decent burial suitable to the wishes of my friends and relatives pay my funeral expenses and also all my just debts out of the money that may first come into his hands in virtue of his Executorship.

Item - I give and bequeath to my son Marcus Swindell the following negro slaves (viz) Eupheme & her child Elisa, Mosella & her two children, Vilet & her child Warren, Aaron and Annis to him his heirs and assigns forever.

Item - I give and bequeath to my grand children Joel Swindell, Dixon Swindell, Cornelius Swindell, Dorcas Hodges, David D. Swindell, Morde? Gibbs, Hardy Swindell, Solomon F. Swindell and Sally Ann Swindell the following negroe slaves (viz) Nance and child, Dinar and Willis top their heirs and assigne forever.

Lastly I hereby constitute and appoint my trusty friend and son Marcus Swindell my Executor to this my Last Will & Testament to have the same executed according to its full intent and purpose thereby revoking all others by me heretofore made.

In witness whereof I the said Dorcas Swindell do hereunto set my hand and affix my seal the 4th day of April A.D. 1854.

Signed sealed published and declared by the said Dorcas Swindell to be her Last Will & Testament in presence of us who at her request and in her presence do subscribe our names thereto.

Hyde County Sessions - Feby. Term 1857
    Then was the within & foregoing paper writing purporting to be the last Will & Testament of Dorcas Swindell, dec'd., exhibited for probate in Open Court by Marcus Swindell the Executor therein named and the due execution by the said Dorcas Swindell is proved by the oath and examination of Jones Boomer one of the subscribing witnesses thereto.  It is therefore considered by the Court that the said paper writing and every part thereof is the last Will and Testament of the said Dorcas Swindell, dec'd., and the same is ordered to be recorded and filed.  And thereupon the said Marcus Swindell, Executor as aforesaid, duly qualified as such by taking the oath required by law.
