I Andrew Shanklin of the county of Hyde and State of North Carolina being of sound mind and memory do make and publish this my last will and testament hereby revoking and making void all former wills by me at any time heretofore made and first I direct that my body be decently intered and to such worldly estate as it hath pleased God to intrust me with I dispose of the same as follows.  First I direct that all my debts and funeral expenses be paid as soon after my decease as possible out of the first moneys that shall come into the hands of my executor from any portion of my estate real or personal.

Secondly I give and bequeath to my brother John Shanklin of Donegal, Ireland his heirs executors & administrators forever all my personal estate of every description including money notes binds accounts and demands of every sort.

Secondly I give and devise to my esteemed friend Daniel Shaw of Wysocking in Hyde County aforesaid his heirs and assigns forever the being my executor hereinafter named all my lands tenements hereditaments and all rights privileges and appertenances thereunto belonging including my share of the steam mill to have & to hold to him his heirs and assigns forever in trust & for the following purposes, to wit--that he or whoever by him shall have the possession of any or all my real estate improve and use it to the best advantage and pay over the net and clear yearly profits thereof to my brother John Shanklin aforesaid his heirs executors & administrators so long as he shall hold any part thereof in trust and that my executor aforesaid shall bargain & sell alien & convey that part of my lands & tenements bounded by the lake on the north on the east by land of David Carter on the south by land belonging to the heirs or devisees of Hugh Jones, deceased, & on the west by land of said David Carter so so as the price of thirty dollars per acre or more can be obtained for the same & that my said executor shall sell my part of the steam mill tract of land and my part of the mill so soon as he can obtain costs of the same and that my executor herein named pay over to my said brother John Shanklin all the net proceeds of the sale of either tract of land aforesaid as soon as practicable or to his heirs & to effectuate these my purposes & intentions I do hereby vest in my executor full power & authority to dispose of all my real estate in fee simple or otherwise in as full and large a manner in every respect as I could myself do it living, and furthermore I empower & direct my executor to sell all my perishable estate as soon after my decease as legal notice may admit also I direct & impower my executor to insure annually & to keep ensured all my part of the steam mill aforesaid until she can me sold as above directed and I do hereby make and ordain my esteemed friend Daniel Shaw of Wysocking aforesaid my sole executor of this my last will & testament.

In testimony whereof I hereto affix my hand and seal this twenty first day of February one thousand eight hundred & thirty seven.

    Then the execution of the foregoing instrument purporting to be the last will & testament of Andrew Shanklin late of said county, deceased, duly proved in court so as to pass both his real and personal estate by the testimony of Hezekiah Farrow one of the attesting witnesses thereto.  Let it be recorded.
