Ananias Sadler - 1852

I Ananias Sadler of said County being now in good health and of sound mind at the same time knowing that life is uncertain & death certain do now make and publish this my Last Will and Testament as follows:

1st  I give to my beloved wife the lands & plantation where I now live containing 48 acres during her natural life also a privilege of fire wood and rail timber on a tract of land known as the Wahab land.  Also one negro woman by the name of Emily one child by the same of Caroline one other child by the name of Miller.  3 choice cows & calves 3 feather beds & furniture.  1 horse her choice and cart one yoke of oxen and cart 1 buggy & harness one plow and harness.  3 choice hoes 10 head of hogs 6 head of sheep, all the poultry that may be on hand at my death, and as much of the using things as she may need for her own use she being the judge of the amount herself.  Also one negro man by the name of Alexander and one years provision from my death that is after that time.

Clause 2nd  I give to my Daughter Nancy now married to D. S. Pugh 54 acres of land more or less adjoining the land where Pugh now lives and known as the Wallace land beginning at the southeast corner of Pugh’s garden, running south with the State Canal to the lane Green Sadler’s land or to the privilege owned by John Midyett to the road there West with said Midyett’s line to Milton Selby’s line, then North with said Selby’s line to a ditch that runs through the field down to the D. S. Pugh’s Northwest corner of the lot of land where he now lives then with said ditch to the barn & through the barn to the state canal then down the canal to the beginning this includes the lot where Pugh lives which I have given him a deed for heretofore which will make in all about 55 acres.  All the above named land I do hereby bequeath to her during her natural life, and if she dies without leaving a lawful heir and it living at the day of her death then I will that the above name land go to my son David G. Sadler forever, excepting that part which Pugh has a deed for which is his own right & property independent of this Will.  I also will to the above legacy a privilege of firewood & rail timber on Wahab land and on the Tooly patent.

Clause 3rd  I give to my son David Graham Sadler 55 acres of land known as part of the Wallace land, beginning at the ditch Pugh’s North East corner near the barn running West through the barn and with Pugh’s line to the land heretofore given to my Daughter Nancy then West with her line to Milton Selby’s line then North with his line to the corner then East with said Selby’s other line to the State Canal then South with the canal to the first station.  Also one negro boy by the name of George one horse bridle & saddle one that is called his now, one shot gun, also a privilege of fire wood on a tract of land known as the Wahab land also on a tract known as the Tooly patent.  I want it to be distinctly understood that all the heirs is to have equal privilege to wood & timber on the two tracts Wahab & Tooley lands.

Clause 4th  I will that at the death of my wife that the land which is willed to her go to my daughter Zada Sadler and her heirs forever and the negroes & other property which is willed to my wife her lifetime be divided between all the heirs which may be then living that is Nancy if alive D. G. Sadler and Zada Sadler I will that all the residue of my property not named in none of the legacys be sold on credit of 6 or 9 months both real & personal and applied to the payments of my just debts and if there be any overplus that it be divided equally among my wife and all the children share & share alike and I do here constitute and appoint my very worthy friend ________________ my Executor to carry this my Will into execution and my desire is that he will carry out every part & clause thereof according to the true construction of the same.

In witness whereof I hereunto set my hand & seal this 7th day of Sept. 1852.

Hyde Co, NC, Court of Pleas & Quarter Sessions  -  February Term A.D. 1853
    Daniel S. Pugh brought into Court the will of Ananias Sadler that was found among the valuable papers of Ananias Sadler.  There being no subscribing witness, three credible witnesses Frederick S. Roper, James Boomer & Will I. Russel swore the hand writing and signature to be that of Ananias Sadler.  Proved and admitted to probate, Daniel S. Pugh appointed Administrator of said Will and entering into bond, $5,000 with Marcus Swindell, S. H. Ritch, F. S. Roper & Arnold Gray, sureties.
