I, Bryan A. Rue of the County of Hyde and State of N. Carolina being of sound mind and memory but considering the uncertainty of my earthly existence do and declare this my last Will & Testament in matter and form following:  that is to say,

First, my executor shall provide for my boddy a decent burial. 

Seconly, I will that my Executor shall have my store house & warehouse at Fairfield finished and pay for the same with the money he collects from the sale of goods and collection of debts, or otherwise.

I will that my Executor settle up my estate by selling my stock goods either by private or public sale as he shall see proper, and after the store & warehouse shall be finished to sell the same with lot, also sell my interest in my Currituck land after having disposed of all my property by sale.  It is my desire that all of my debts should be paid and the balance of my property to be distributed as follows.  One third to be given to my brother Wm. Thomas Rue.  One third to be given to my Brother George W. Rue, and one third to be equally divided between two of William Sadler's children, one by the name of Samuel B. Sadler and the other named James Riley Sadler.  The above property to be sold by private or public sale as the Exr. may see proper.  I hereby appoint my friend John M. Mann, Executor to the above Will.  Given under my hand & seal the 31st day of August 1869.

State of North Carolina, County of Hyde -  In the Probate Court - Sep 1869
    A paper writing purporting to be the last Will and Testament of Bryan A. Rue, deceased, is exhibited before me the undersigned, Judge of Probate for said County.  John M. Mann the Executor therein named, and the due execution thereof by the said Bryan A. Rue, by the oath and examination of Wm. F. Midyett one of the subscribing witnesses thereto, and by John M. Mann the Executor therein named who is not a subscribing witness, but who was present when the said Will was executed.  Wm. F. Midyett being duly sworn doth say that he is a subscribing witness to the paper writing now shown him purporting to be the last Will and Testament of Bryan A. Rue.  That the said Bryan A. Rue, in the presence of this deponent subscribed his name at the end of said paper writing, which is now shown as aforesaid, and which bears date on the 31st day of August 1869.  And the deponent further saith that the said Bryan A. Rue, the Testator aforesaid, did at the time of subscribing his name as aforesaid, declare the paper so subscribed to be his last Will and Testament, and this deponent thereupon did subscribe his name as a subscribing witness thereto, at the request and in the presence of the said Testator.  And this deponent further saith that at the said time the said Bryan A. Rue, was of sound mind and memory, of full age to execute a Will, and was not under any restraint to the knowledge, in formation or belief of this deponent, and further these deponents saith not.
