In the Name of God, Amen. I, Thomas Pain, of Hyde County being very sick and week in body but of sound and perfect mind and memory considering the uncertainty of this life and being of sound and perfect mind blessed be almighty god for the same, I do make and publish this my last will and testament in manner and form following, that is to say:
First I give and bequeath unto my well beloved wife Dority two negroe men named Benjamin and James. Also I give and bequeath to my son and daughter, David and Zilpha, ninety-three acres of land on Longshold. Also I give and bequeath to my daughter Bethany one bed, bedstead and furniture. Also I give and bequeath to my daughter Zilpah one bed and furniture. Also I give and bequeath to my daughter Dorcas one bed and furniture. Also I give and bequeath to my sons John, Edward, Saunderson, Benjamin, Thomas, William and Cornelius all my land on the banks. Also I give and bequeath to my sons John, Edward, Saunderson, Benjamin, Thomas, William and Cornelius all my horses except three cart horses. Also if any of the brothers die without leaving heirs his property to go back to his brother named John, Edward, Saunderson, Benjamin, Thomas, William, and Cornelius. Also I give and bequeath to my son Joseph's heirs, five head of sheep. Also I give and bequeath to my wife the schooner "David" and the canoes and nets. Also I give and bequeath to my son Benjamin my church bible. Also I give and bequeath to my daughter Zilpha five head of sheep. Also I give and bequeath to my wife three steers. Also I give and bequeath to my wife the first choice of cow & calf. Also I give and bequeath to my daughter Bethany the second choice cow and calf. Also I give and bequeath to my daughter Dorcas two head of sheep. To my son David five head of sheep. Also to my wife and children John, Edward, Saunderson, Benjamin, William and Cornelius all the remainder of the sheep. Also I give to my children John, Bethany, Edward, Saunderson, Benjamin, William, Cornelius and Joseph's heirs all the remainder of the cattle. Also at the death of my wife or when the youngest child comes of age for the boat and canoes and nets to be sold amongst my seven sons, John, Edward, Saunderson, Benjamin, Thomas, William and Cornelius. Also I give to my wife all my hogs. Also I leave my boat frame to my seven sons to sell and divide the money among them. I give to my wife three horses, my saddle and cart. Also I give to my son Saunderson the gun he has. To my son Thomas the gun he now shoots. To my son William my English musket. To my son Cornelius the other gun. To my son Benjamin the gun he now shoots. Also I give to my sons all the carpenters tools to be divided amongst them. Also I give to my son John one dictionary. To my son Thomas one book called the Holy Bible. Also I give to my sons John, Edward, Saunderson, Benjamin, Thomas, William and Cornelius one negro man called Boaroz ?. Also at the expiration of my wife's widowhood then all the property to come back to my seven sons. Also I give to my four sons, Benjamin, Thomas, William and Cornelius one bed and furniture a piece. All the rest of my goods and chattles to be sold and the money to be divided amongst my wife and children, John, Bethany, Edward, Saunders, Benjamin, Thomas, William, Cornelius and Joseph's heirs. John Paine and Benjamin Paine whom I appoint executors of this my last will and testament hereby revoking all former wills by me made. In witness whereof I have hereunto set my hand and seal this 29th day of November 1824.

May Term 1826
    The last will & testament of Thomas Pain was produced in open court & proved by the oath of Jacob Midyett. John Pain & Benjamin Pain qualified as executors to this will.
August Term 1826
    Inventory & account of sales of Thomas Pain, dec'd., was returned by the executors.
